BOONE, MICHAEL JULIAN BOND, MATT WESTMORELAND AND DUSTIN HILLIS TO AMEND THE ATLANTA CITY CODE, PART 16, ZONING ORDINANCE; CHAPTER 29, DEFINITIONS, 10 (B) SO AS TO AMEND THE DEFINITION OF “FAMILY” IN REFERENCE TO OCCUPANCY OF SINGLE FAMILY DWELLING UNITS; AND FOR OTHER PURPOSES.

WHEREAS, single family zoning districts are designed to support low density dwelling units; and 

WHEREAS, single family homes are meant to be used as living space for a single family and not multiple unrelated individuals; and

WHEREAS, single family zoning districts allow homes that a single-family unit or other related individuals are expected to live in, and does not permit triplexes, or other multi-family options where there will be more than one unit; and

WHEREAS, unrelated individuals can live in a single-family home together, not be a family or related, the single-family zoning prohibits dividing a house into a number of separate units; and

WHEREAS; occupancy limits help to prevent substandard, unsafe conditions, dividing rooms into multiple cubbyholes; and

WHEREAS, limiting the number of unrelated occupants in a single home or dwelling unit will help to preserve the intent of single-family zoning districts.

THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS AS FOLLOWS:

SECTION 1.   That the Atlanta City Code, Part 16, Zoning Ordinance; Chapter 29, Definitions, 10 (B) which reads as follows: 

Family: One or more persons occupying a single dwelling or lodging unit, provided that, unless all members are related by blood, marriage or adoption, no such family shall contain over six persons, with the following exceptions. Domestic servants employed on the premises may be housed on the premises without being counted as a family. In a dwelling unit, not more than two rooms not containing independent kitchen facilities may be occupied by a total of four or less roomers who may also board with the family. Four or less boarders, including but not necessarily restricted to roomers on the premises, may be accommodated for compensation for any period, including daily, weekly or monthly periods. The term "family" shall not be construed to mean fraternity, sorority, club, student center, group care homes, foster homes and similar uses.
