WHEREAS, Dickson Place, N.E. is a small street in midtown located near Piedmont Park, which is a major traffic generator and is heavily frequented by park users and event goers; and
WHEREAS, available on-street parking has become very difficult for residents along Dickson Place, N.E. due to its proximity to the heavy traffic generators and nearby construction projects; and
WHEREAS, the residents of Dickson Place have requested the Departments of Public Works to establish a Residential Permit Parking Program along Dickson Place, N.E.; and
WHEREAS, Section 150-148(b) of the Code of Ordinances requires that a residential permit parking area be no less than two contiguous block faces; and
WHEREAS, the location of parking spaces requested to be included in the Program is less than the two contiguous block face requirement, and therefore an exemption from the Code requirement is necessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATLANTA, as follows:
SECTION 1: That the Mayor, or his designee, is authorized to create a Residential Permit Parking Program along Dickson Place, N.E. located between 11th Street, N.E. and 1ih Street, N.E. that subject to the provisions of Sections 2 through 6 below, will comply in all relevant respects with the program and requirements set out in Sections 150-150 through 150-158 of Division 4, Article IV, Chapter 150 of the City of Atlanta Code of Ordinances.
SECTION 2: That this Residential Permit Parking Program is temporary, and will only last for duration of twelve (12) months.
SECTION 3: That available on-street parking spaces along Dickson Place, N. E. located between 11th Street, N. E. and 12th Street N. E. , prohibit parking without a residential parking permit from 10:00 a.m. to 10:00 p.m. daily.
SECTION 4: That due to the temporary nature of the permit parking program, the requirements of Section 150-148, including the petition and minimum two contiguous block face requirement, are hereby waived for purposes of this ordinance only.
SECTION 5: That due to the temporary nature of the permit parking program, the requirements of Section 150-149, including eligibility of an area for a permit parking program, are hereby waived for the purposes of this ordinance only.
SECTION 6: That appropriate street signage pursuant to the provisions of City of Atlanta Code Section 150-147 shall be installed by the Department of Public Works within thirty days of the legal effectiveness of passage of this Ordinance.
SECTION 7: That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed.
