A RESOLUTION BY COUNCILMEMBER CARLA SMITH AUTHORIZING THE MAYOR, OR HIS DESIGNEE, ON BEHALF OF THE CITY OF ATLANTA, TO ENTER INTO AN AGREEMENT PURSUANT TO THE CITY OF ATLANTA CODE OF ORDINANCES ARTICLE X, SECTION 2-1191.1, SPECIAL PROCUREMENT WITH VIA PARTNERSHIP, FOR FC- 8706, RENEW ATLANTA PUBLIC ART CONSULTANT, TO DEVELOP A PUBLIC ART MASTER PLAN FOR THE CITY OF ATLANTA RENEW ATLANTA BOND PROGRAM, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY TWO THOUSAND DOLLARS AND NO CENTS ($122,000.00), ALL WORK TO BE CHARGED TO AND PAID FROM FUND, DEPARTMENT ORGANIZATION AND ACCOUNT NUMBER LISTED HEREIN; AND FOR OTHER PURPOSES

WHEREAS, the Atlanta City Council unanimously adopted Resolution 14-R-4374 on January 5, 2015, approved by the Mayor on January 6, 2015, calling for a Special Election to be held on March 17, 2015 asking voters to authorize the issuance of a $250,000,000.00 General Obligation Bond ("Renew Atlanta Bond Program"); and

 

WHEREAS, the Renew Atlanta Bond Program was subsequently authorized by the City of Atlanta ("City") voters in the Special Election; and

 

WHEREAS, the Renew Atlanta Bond Program expressly provides for a portion of the bond proceeds to be used to provide new art installations on City owned property and right-of-way, in order to enhance the beauty of  public spaces throughout the City, preserve and promote the City's  history and culture, and foster a sense of pride in the City and its neighborhoods; and

 

WHEREAS, the existing 2001 Public Art Master Plan by the Office Cultural Affairs was developed prior to the existence of the Renew Atlanta Bond Program; and

 

WHEREAS, there is a need to develop a greatly enhanced public art master plan designed to implement the added resources available under the Renew Atlanta Bond Program; and

 

WHEREAS, the project is highly time-sensitive in order to allow the appropriate sequencing of required elements including, but not limited to, planning, community engagement, community visioning, field assessment and creating a benchmark system that will be completed by mid-April

2017; and

 

WHEREAS, the Mayor has determined that it is in the City of Atlanta's best interest to assign the development of a Renew Atlanta Bond Program Public Art Master Plan to a consultant; and

 

 

WHEREAS, Via Partnership possesses the unique ability and experience necessary to develop a Public Art Master Plan for the City, including, but not limited to, planning, community engagement, community visioning, field assessment and creating a benchmark system; and

 

WHEREAS, Via Partnership has created Public Art Master plans for municipalities of the same size and scope needed for the City's Public Art Master Plan; and

 

WHEREAS, Section 2-1191.1 of the Procurement and Real Estate Code authorizes special procurements where the Chief Procurement Officer has determined that an unusual or unique situation exists that make the application of all requirements of competitive sealed bidding or competitive sealed proposals contrary to the public interest, and has further determined that there is only one logical choice as to a contractor to provide the goods or services necessitated by the special procurement, and

 

WHEREAS, the Chief Procurement Officer after conducting an investigation and making the requisite findings, that authorized a Special Procurement for professional services to be provided by Via Partnership; and

 

WHEREAS, the Mayor recommends that the City enter into a Special Procurement Agreement with Via Partnership, for FC- 8706, Renew Atlanta Public Art Consultant, in an amount not to exceed One Hundred Twenty Two Thousand Dollars and No Cents ($122,000.00); and

 

WHEREAS, the term of this Agreement shall before One Hundred Twenty (120) days effective upon the issuance of the notice to proceed by the Office of the Mayor;

 

THE CITY COUNCIL OF  THE CITY OF  ATLANTA, GEORGIA HEREBY RESOLVES, that the Mayor or his designee is authorized to enter into a Special Procurement Agreement with Via Partnerships, for FC- 8706, Renew Atlanta Public Art Consultant, in an amount not to exceed One Hundred Twenty Two Thousand Dollars and No Cents ($122,000.00).

 

 

 

BE IT FURTHER RESOLVED, that all contracted work shall be charged to and paid from FDOA 3148 (2015 Municipal Facilities Bond Fund) 040416 (EXE Capital Projects) 5212001 (Consulting/Professional Services) 1512000 (Accounting) 22281 (Infrastructure Bond -OEAM) 04112217 (Municipal Facilities)

 

 

BE IT FURTHER RESOLVED, that the City Attorney, or her designee, is hereby directed to prepare the appropriate Agreement, acceptable as to form, for execution by the Mayor or his designee.

 

 

BE IT FINALLY RESOLVED, that the Agreement shall not become binding upon the City, and the City shall incur no obligation or liability under it until it has been approved as to form by the City Attorney, executed by the Mayor, attested to by the Municipal Clerk and delivered to Via Partnership.
