AN ORDINANCE BY COUNCILMEMBER KEISHA LANCE BOTTOMS AS SUBSTITUTED BY COMMUNITY DEVELOPMENT AND HUMAN RESOURCES COMMITTEE TO AMEND THE LAND USE ELEMENT OF THE 2011 CITY OF ATLANTA COMPREHENSIVE DEVELOPMENT PLAN (CDP) SO AS TO DESIGNATE PROPERTIES AT THE CASCADE FALLS NEIGHBORHOOD TO THE SINGLE-FAMILY RESIDENTIAL, MEDIUM DENSITY RESIDENTIAL AND OFFICE INSTITUTIONAL LAND USE DESIGNATIONS AS DESIGNATED BELOW; AND FOR OTHER PURPOSES.

Body

WHEREAS, certain resident electors and the owners of real properties have petitioned the City of Atlanta for annexation from unincorporated Fulton County to the corporate limits of the City of Atlanta; and

 

WHEREAS, the properties are improved with single-family residential dwellings, undeveloped land and a community arts center; and

 

WHEREAS, the Bureau of Planning recommends that upon annexation the properties be designated to the single-family residential (SFR), medium density residential (MDR), and office institutional (O-I) land use classifications; and

 

WHEREAS, the City Council finds that the SFR, MDR and O-I land use classifications are the appropriate classifications for the properties.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS AS FOLLOWS:

 

SECTION 1.              That the 2011 City of Atlanta Comprehensive Development Plan (CDP) is hereby amended by changing the Land Use Element of said Plan so as to designate certain properties of the Cascade Falls Neighborhood, as more fully delineated on Exhibit “A” and which is incorporated herein by reference, to the Single-Family Residential, Medium Density Residential and Office Institutional land use designations as follows:

 

Single Family Residential: 510 Semira Street, 530 Semira Street, Cascade Road, 130 Milano Drive, 520 Semira Street, 175 Milano Drive, 4950 Cascade Road, 4960 Cascade Road, 4970 Cascade Road, 4900 Cascade Road, 140 Milano Drive, 155 Milano Drive, 100 Milano Drive, 110 Milano Drive, 500 Semira Street, 185 Milano Drive, 145 Milano Drive, 120 Milano Drive, 150 Milano Drive, 505 Semira Street, 115 Milano Drive, 170 Milano Drive, 220 Milano Drive, 195 Milano Drive, 165 Milano Drive, 525 Semira Street, 160 Milano Drive, 210 Milano Drive, 105 Milano Drive, 0 Cascade Road;

 

Medium Density Residential: 125 Milano Drive and 135 Milano Drive; and

 

Office-Institutional: 915 New Hope Road (Southwest Arts Center)

 

SECTION 2.              That all ordinances or parts of Ordinances that are in conflict with this Ordinance are hereby waived to the extent of the conflict.

AS SUBSTITUTED BY ZONING COMMITTEE

 

AN ORDINANCE TO ZONE PROPERTIES LOCATED AT THE CASCADE FALLS NEIGHBORHOOD TO THE R-3 AND PD-H (SINGLE FAMILY RESIDENTIAL), RG-3 (MEDIUM DENSITY RESIDENTIAL) AND O-I (OFFICE INSTITUTIONAL) ZONING DISTRICTS AS DESIGNATED BELOW; AND FOR OTHER PURPOSES.

 

WHEREAS, certain resident electors and the owners of real properties have petitioned the City of Atlanta for annexation from unincorporated Fulton County to the corporate limits of the City of Atlanta; and

 

WHEREAS, some properties are improved with single-family residential dwellings, others are undeveloped land and another is improved with a community arts center; and

 

WHEREAS, consistent with the current county zoning, the Office of Planning recommends that upon annexation the properties be zoned to the R-3 and PD-H (single-family residential), RG-3 (medium density residential), and O-I (office institutional) zoning classifications; and

 

WHEREAS, the City Council finds that the R-3 and PD-H (single-family residential), RG-3 (medium density residential), and O-I (office institutional) zoning classifications are the appropriate classifications for the properties as more particularly set forth herein.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS AS FOLLOWS:

 

SECTION 1.              That the Zoning Ordinance of the City of Atlanta be amended, and the official zoning map established in connection therewith be changed so that the properties having a street address of 510 Semira Street, 530 Semira Street, Cascade Road, 130 Milano Drive, 520 Semira Street, 175 Milano Drive, 4900 Cascade Road, 140 Milano Drive, 155 Milano Drive, 100 Milano Drive, 110 Milano Drive, 500 Semira Street, 185 Milano Drive, 145 Milano Drive, 120 Milano Drive, 150 Milano Drive, 505 Semira Street, 115 Milano Drive, 170 Milano Drive, 220 Milano Drive, 195 Milano Drive, 165 Milano Drive, 525 Semira Street, 160 Milano Drive, 210 Milano Drive, 0 Cascade Road be zoned to the PD-H (planned development housing) district, to wit:

 

Said Property is more specifically shown on the attached map, Exhibit “A”, which is hereby made part of this Ordinance.

 

SECTION 2.              That the Zoning Ordinance of the City of Atlanta be amended, and the official zoning map established in connection therewith be changed so that the property having a street address or parcel identification number of 105 Milano Drive, 4950 Cascade Road, 4960 Cascade Road, 4970 Cascade Road and 14F0081 LL0396 be zoned to the R-3 district, to wit:

 

              Said Property is more specifically shown on the attached map, Exhibit “A”, which is hereby made part of this Ordinance.

 

 

 

SECTION 3.              That the Zoning Ordinance of the City of Atlanta be amended, and the official zoning map established in connection therewith be changed so that the property having a street address of 125 Milano Drive and 135 Milano Drive be zoned to the RG-3 (medium density residential district, to wit:

             

              Said Property is more specifically shown on the attached map, Exhibit “A”, which is hereby made part of this Ordinance.

 

 

SECTION 4.              That the Zoning Ordinance of the City of Atlanta be amended, and the official zoning map established in connection therewith be changed so that the property having a street address of 915 New Hope Road (Southwest Arts Center) be zoned to the O-I (office institutional) district, to wit:

              Said Property is more specifically shown on the attached map, Exhibit “A”, which is hereby made part of this Ordinance.

 

SECTION 5.              That the maps referred to be changed to conform to the terms of this Ordinance.

 

SECTION 6.              That all Ordinances or parts of Ordinances in conflict with the terms of this Ordinance are hereby repealed to the extent of the conflict.
