AN ORDINANCE BY COUNCILMEMBER KEISHA LANCE BOTTOMS TO AMEND THE LAND USE ELEMENT OF THE 2011 CITY OF ATLANTA COMPREHENSIVE DEVELOPMENT PLAN (CDP) SO AS TO DESIGNATE PROPERTIES AT THE SOUTHWEST CASCADE CORRIDOR TO THE MIXED USE LAND USE DESIGNATION AS DESIGNATED BELOW; AND FOR OTHER PURPOSES.

(Public Hearing held June 13, 2016.)

WHEREAS, certain resident electors and the owners of real properties have petitioned the City of Atlanta for annexation from unincorporated Fulton County to the corporate limits of the City of Atlanta; and

WHEREAS, the Bureau of Planning recommends that upon annexation the properties be designated to the mixed use (MU) land use classification; and

WHEREAS, the City Council finds that the MU land use classification is the appropriate classification for the properties.

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS AS FOLLOWS:

SECTION 1.  That the 2011 City of Atlanta Comprehensive Development Plan (CDP) is hereby amended by changing the Land Use Element of said Plan so as to designate certain properties of the Southwest Cascade Corridor, as more fully delineated on Exhibit "A" and which is incorporated herein by reference, to the Mixed Use land use designation as follows:

Mixed Use: 3510 Cascade Road (#14 0248 LL0236), 0 Cascade Road (#14 0248 LL0335), 3520 Cascade Road (#14 0248 LL0343) and 0 Cascade Road (#14 0248 LL0269)

SECTION 2.  That all ordinances or parts of Ordinances that are in conflict with this Ordinance are hereby waived to the extent of the conflict.
