A RESOLUTION BY COUNCILMEMBER C.T. MARTIN AS SUBSTITUTED BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR OR HIS DESIGNEE TO ENTER INTO AMENDMENT NUMBER 1 TO THAT CERTAIN SERVICES AGREEMENT DATED AUGUST 9, 2013 BETWEEN THE CITY OF ATLANTA AND ATLANTA BELTLINE, INC., ON BEHALF OF THE DEPARTMENT OF PUBLIC WORKS, TO AMEND THE SCOPE OF WORK OF THE AGREEMENT TO INCLUDE PROJECT MANAGEMENT FOR RENEW ATLANTA INFRASTRUCTURE BOND PROJECTS ON A TASK ORDER BASIS; AND FOR OTHER PURPOSES.

WHEREAS, Resolution 13-R-3314, adopted by the Atlanta City Council on July 15, 2013 and approved as per City Charter Section 2-403 on July 24, 2013, authorized the execution and delivery of a Services Agreement between the City of Atlanta (“City”) and Atlanta Beltline Inc., (“ABI”) regarding the Atlanta Streetcar Expansion Strategy and the Atlanta BeltLine Transit Element (the “Agreement”); and

 

WHEREAS, the Agreement authorized the City to engage ABI as its agent to oversee and contract for the planning, design and construction of projects designed to complete portions of the Connect Atlanta Plan, the Atlanta BeltLine Subarea Master Plans and the Atlanta Streetcar Expansion Strategy including the Atlanta BeltLine Component (collectively the “Project”); and

 

WHEREAS, ABI and the City (the "Parties") seek to amend the Scope of Work of the Agreement to engage ABI as the City’s agent to support the design, management, construction and project closeout of two (2) Complete Streets projects associated with the Renew Atlanta Bond Program; and 

 

WHEREAS, the Parties desire to enter into Amendment Number 1 to the Agreement, in substantial form as attached in Exhibit A; and

 

WHEREAS, the Commissioners of the Department of Public Works and the General Manager  of the Renew Atlanta Infrastructure Bond recommend issuing Task Order No. 1 for the closeout of two (2) Complete Street projects in an amount not to exceed $2,212,000.00.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY

RESOLVES, that the Mayor is authorized to enter into Amendment Number 1 to the Services Agreement with ABI to amend the Scope of Work of the Agreement to engage ABI as the City’s agent to support the design, management, construction and project closeout of two (2) Complete Streets projects associated with the Renew Atlanta Bond Program.

 

BE IT FURTHER RESOLVED, that the City Attorney is authorized to negotiate, prepare, and/or review Amendment Number 1 to the Services Agreement to affect the intent of this resolution provided that such Amendment is in compliance with the conditions set forth herein.

 

BE IT FURTHER RESOLVED, that the Amendment to the Agreement (and any additional Amendments to the Agreement) will not become binding upon the City and the City will incur no obligation or liability under it until it has been executed by the Mayor, attested to by the Municipal Clerk, approved by the City Attorney as to form and delivered to ABI.

 

BE IT FURTHER RESOLVED, that after the Amendment to the Agreement has been executed by and delivered to both parties, the Mayor, or his designee, is authorized to issue Task Orders for the closeout of two (2) Complete Street projects located on Ralph David Abernathy Boulevard and University Avenue for the Renew Atlanta Infrastructure Bond.

 

BE IT FURTHER RESOLVED, that all contracted work for the Ralph David Abernathy Blvd Complete Street project shall be charged to and paid from PTAEO: 13112184 201.15 314722280 5414002 COA, FDOA:  3147 (2015 Infrastructure Bond Fund) 130308 (DPW Transportation Design) 5414002 (Facilities not Buildings-CIP) 4270000 (Traffic Engineering) 112184 (Transportation Infrastructure) 22280 (Infrastructure Bond-DPW).

BE IT FURTHER RESOLVED, that all contracted work for the University Avenue Complete Street project shall be charged and paid from PTAEO: 13112184 201.13 314722280 5414002 COA, FDOA: 3147 (2015 Infrastructure Bond Fund) 130308 (DPW Transportation Design) 5414002 (Facilities not Buildings-CIP) 4270000 (Traffic Engineering) 112184 (Transportation Infrastructure) 22280 (Infrastructure Bond-DPW).

BE IT FINALLY RESOLVED, that the Task Orders will not become binding upon the City, and the City will incur no obligation or liability under them until each has been executed by the Mayor, attested to by the Municipal Clerk, approved by the City Attorney as to form and delivered to ABI.
