A SUBSTITUTE ORDINANCE BY COMMUNITY DEVELOPMENT/HUMAN RESOURCES COMMITTEE AUTHORIZING THE MAYOR TO ENTER INTO A PROJECT FRAMEWORK AGREEMENT (“PFA”) BETWEEN THE CITY OF ATLANTA AND THE GEORGIA DEPARTMENT OF TRANSPORTATION (“GDOT”) FOR THE LENOX ROAD CORRIDOR STUDY, PROJECT IDENTIFICATION NUMBER 0015005; AUTHORIZING THE MAYOR TO ENTER INTO A PROJECT MANAGEMENT AGREEMENT (“PMA”) BETWEEN THE CITY OF ATLANTA AND THE BUCKHEAD COMMUNITY IMPROVEMENT DISTRICT FOR THE LENOX ROAD CORRIDOR STUDY PROJECT IDENTIFICATION NUMBER 0015005; AMENDING THE 2017 INTERGOVERNMENTAL GRANT FUND BUDGET ON BEHALF OF THE DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT BY TRANSFERRING TO AND FROM APPROPRIATIONS IN THE AMOUNT OF TWO HUNDRED THOUSAND DOLLARS ($200,000.00) TO FUND THE STUDY; AND FOR OTHER PURPOSES.

WHEREAS, Georgia Department of Transportation (“GDOT”) has identified certain proposed transportation facility improvements along the Lenox Road Corridor, Project Identification 0015005 (the “Project”); and

 

WHEREAS, the City desires to enter into contract with GDOT (“Project Framework Agreement”) whereby the City will undertake the Preconstruction Engineering (the “Lenox Road Corridor Study”) in return for GDOT providing federal funding in the amount of $200,000 and contingent on a local match of 20% ($50,000) of the total Lenox Road Corridor Study cost of $250,000; and

 

WHEREAS, as currently contemplated, the Lenox Road Corridor Study will determine the feasibility of adding sidewalk, cycle track, improved pedestrian connectivity to a corridor that is largely inaccessible to bikes and pedestrians. The study area includes Lenox Rd. from the Lenox MARTA Station to Piedmont Rd.  (1.3 miles) and Phipps Blvd. from Lenox Rd. to Peachtree Rd. (.52 miles). The scope of work includes public involvement, survey of right of way, survey of structures and constraints including sound walls, a bridge over GA400 and a bridge over Lenox Rd., environmental studies, develop a need and purpose statement and produce an implementation plan and concept report; and

 

WHEREAS, upon signing the Project Framework Agreement, the City desires to sign a Project Management Agreement with a third-party to conduct the Lenox Road Corridor Study and fulfill the City’s obligations under the Project Framework Agreement; and

 

WHEREAS, Article IX, Section VII of the Constitution of the State of Georgia authorizes municipalities to create community improvement districts and pursuant to the “Atlanta Community Improvement District Act”, enacted by the Georgia General Assembly as House Bill 544, the City of Atlanta created the Buckhead Community Improvements District (“BCID”) pursuant to the constitutional and statutory authority cited herein (City Council Resolution No. 99-R-1154); and

             

WHEREAS, the BCID is authorized to contract with the City pursuant to the constitutional and statutory authority above referenced; and

 

WHEREAS, the City and BCID believe that the Lenox Road Corridor Study offers unique opportunities to significantly improve mobility in the Buckhead area; and

 

WHEREAS, the City desires the continued involvement of the BCID in the development in the area comprising the Project and the BCID desires to work with the City to pursue the Lenox Road Corridor Study; and

 

WHEREAS, the BCID  has committed funds in the amount of $50,000 for the Lenox Road Corridor Feasibility Study and this amount fulfills the 20% local government match required of the City in order to allow the City to utilize the STP funding programmed to the Project at present or in the future; and

 

WHEREAS, the City desires to contract with GDOT and BCID  for  the Lenox Road Corridor Study as more fully set forth under the terms set forth therein  and the contractual terms between the City and GDOT in the Project Framework Agreement; and

 

WHEREAS, the Department of Planning and Community Development, Office of Mobility Planning, will provide oversight of the Lenox Road Corridor Study and contracts.

 

NOW THEREFORE BE AND IT IS ORDAINED BY THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS as follows:

 

SECTION 1: The Mayor is authorized to execute a Project Framework Agreement, in substantial form as set forth in Exhibit “A”, with the Georgia Department of Transportation for the Lenox Road Corridor Study, Project Identification Number 0015005 in an amount not to exceed Two Hundred Fifty-Thousand Dollars and no cents ($250,000.00).

 

SECTION 2: The Mayor is hereby authorized to execute a Project Management Agreement, in substantial form as set forth in Exhibit “B”, with the Buckhead Community Improvement District for the Lenox Road Corridor Study, in substantial form as set forth on Exhibit “B”, in an amount not to exceed Two Hundred Thousand Dollars and no cents ($200,000.00).

 

SECTION 3: That the Agreements set forth in Section 1 and 2 will not become binding on the City and the City will incur no liability or obligation under it until it has been executed by the Mayor, attested to by the Municipal Clerk, approved as to form by the City Attorney and delivered to the Georgia Department of Transportation.

 

SECTION 4: That the 2017 Intergovernmental Grant Fund Budget be and is hereby amended as follows:

SECTION 5: That the Chief Financial Officer is authorized to transfer anticipations and appropriations as specified above in for the federal funds and local match.
