A RESOLUTION BY COUNCILMEMBER IVORY LEE YOUNG JR. AS SUBSTITUTED BY CITY UTILITIES COMMITTEE
AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH SCHNEIDER ELECTRIC/ME CUBED ENGINEERING, JV FOR FC-8047A-2, ENERGY SERVICE PERFORMANCE INITIATIVES, ON BEHALF OF THE DEPARTMENT OF WATERSHED MANAGEMENT, IN AN AMOUNT NOT TO EXCEED THIRTY-SIX MILLION, TWO HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($36,200,000.00); ALL CONTRACTED WORK WILL BE CHARGED TO AND PAID FROM THE FUND DEPARTMENT ORGANIZATION AND ACCOUNT NUMBER LISTED; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”) identified the need for a comprehensive energy management and energy related capital improvement strategy to achieve long term savings through reduced energy and water use at City owned facilities; and

 

WHEREAS, the City determined that the long term savings and reduced energy and water use can be best achieved through multiple performance based agreements that will include both an Investment Grade Energy Audit Agreement (“Audit Agreement”) and a Guaranteed Energy Savings Performance Contract (“GESPC”); and

 

WHEREAS, the City authorized the Audit Agreement portion of FC-8047A-2, Energy Service Performance Initiatives with Schneider Electric/ME Cubed Engineering, JV, on behalf of the Department of Watershed Management, pursuant to Resolution No. 15-R-4477, to perform the Audit Agreement portion and produce an audit report; and

 

WHEREAS, Schneider Electric/ME Cubed Engineering, JV has provided an audit report to the City that includes recommendations for proposed energy savings conservations measures (“Audit Report”); and

 

WHEREAS, the Commissioner of the Department of Watershed Management has reviewed the Audit Report and desires to execute a GESPC to implement the recommendations identified in the Audit Report to achieve long term savings through reduced energy and water use at City owned facilities; and

WHEREAS, the Commissioner of the Department of Watershed Management, the Chief Resilience Officer, and the Chief Procurement Officer recommend that the GESPC portion of FC-8047A-2, Energy Service Performance Initiatives be awarded to Schneider Electric/ME Cubed Engineering, JV in an amount not to exceed Thirty-Six Million, Two Hundred Thousand Dollars and Zero Cents ($36,200,000.00).

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES, that the Mayor, or his authorized designee, is authorized to enter into an agreement with Schneider Electric/ME Cubed Engineering, JV for the GESPC portion of FC-8047A-2, Energy Service Performance Initiatives, on behalf of the Department of Watershed Management, in an amount not to exceed Thirty-Six Million, Two Hundred Thousand Dollars and Zero Cents ($36,200,000.00);

 

BE IT FURTHER RESOLVED, the term of the GESPC will not exceed fifteen (15) years;

BE IT FURTHER RESOLVED, that the Chief Procurement Officer, in consultation with the City Attorney, is directed to prepare a GESPC for execution by the Mayor, or his authorized designee;

BE IT FURTHER RESOLVED, that the agreement will not become binding on the City and the City will incur no obligation or liability under it until it has been duly approved by the City and delivered to Schneider Electric/ME Cubed Engineering, JV; and

 

BE IT FINALLY RESOLVED, that all contracted work will be charged to and paid from the Fund Department Organization and Account Number 5052 (Water and Wastewater RNE Fund) 170201 (DWM Wastewater Treatment & Collection) 5212001 (Consulting Professional Services) 4310000 (Sanitary Administration) and Project Task Award Expenditure and Organization Number 17112948 (Energy Service Performance Initiatives-Schneider Electric/ME Cubed Engineering, JV) 101 (TASK) 505221391 (Water and Wastewater RNE Fund) 5212001 (Consulting Professional Services) COA.
