WHEREAS, the City of Atlanta, (the “City”), administers the U. S. Department of Housing and Urban Development (“HUD”) Section 8 Moderate Rehabilitation Program providing affordable housing through rental subsidies that benefit low-income families and individuals; and
WHEREAS, the City has a previous Housing Assistance Payment (“HAP”) contractual relationship with the Edgewood Center Limited Partnership to provide rental subsidies at Edgewood Center Housing Complex in order to house forty-six (46) low income formerly homeless individuals, under the Section 8 Moderate Rehabilitation Program; and
WHEREAS, HUD has approved funding for a new HAP contract in an amount not to exceed Two Hundred Eighty-Seven Thousand Five Hundred Ninety-Two 00/100 Dollars ($287,592.00) in order to continue to provide affordable and standard housing for the aforesaid low income, formerly homeless individuals through May 2, 2018; and
WHEREAS, the City’s Department of City Planning, Office of Housing and Community Development recommends entering into a HAP contract with Edgewood Center Limited Partnership in an amount not to exceed Two Hundred Eighty-Seven Thousand Five Hundred Ninety-Two 00/100 Dollars ($287,592.00) with a term ending on May 2, 3018.
THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES, that the Mayor be and is hereby authorized to enter into a HAP Contract, on behalf of the City of Atlanta, Office of Housing and Community Development, with Edgewood Center Limited Partnership, for forty-six (46) units at Edgewood Center Housing Complex in an amount not to exceed Two Hundred Eighty-Seven Thousand Five Hundred Ninety-Two 00/100 Dollars ($287,592.00) and for a term ending on May 2, 2018.
BE IT FURTHER RESOLVED, that all expenses shall be charged to and paid from project, Task, Award, Expenditure, Owning Organization:

BE IT FURTHER RESOLVED, that in the event that Edgewood Center Limited Partnership fails to comply with the terms and conditions of the contract renewal, the Mayor or his designee, or the Commissioner of the Department of City Planning, can terminate such contract with the proper notice.
BE IT FURTHER RESOLVED, that the City Attorney or her designee is directed to prepare the appropriate contract for execution by the Mayor.
BE IT FINALLY RESOLVED, that the contract shall not become binding on the City and the City shall incur no obligation or liability upon same until such contract has been approved by the City Attorney or her designee as to form, signed by the Mayor, attested to by the Municipal Clerk and delivered to the Edgewood Center Limited Partnership.

The purpose of this legislation is to add to anticipations and appropriations the amount of Three Hundred Thirty Thousand and Three Hundred Fifty Dollars ($330,350.00) increasing the budget amount authorized by the U.S. Department of Housing and Urban Development (“HUD”) for the City of Atlanta’s Section 8 Moderate Rehabilitation program for the Edgewood Center Housing Complex.
