A RESOLUTION BY COMMUNITY DEVELOPMENT/HUMAN SERVICES COMMITTEE AUTHORIZING THE MAYOR ON BEHALF OF THE CITY OF ATLANTA, TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE BOARD OF REGENTS OF THE UNIVERSITY SYSTEM OF GEORGIA, BY AND ON BEHALF OF GEORGIA STATE UNIVERSITY, REGARDING THE PROVISIONS OF MAINTENANCE AND OTHER SERVICES AT HURT PARK; AND FOR OTHER PURPOSES.

Body

WHEREAS, Hurt Park (Park”) is a 1.87-acre park that is owned by the City of Atlanta (“City”) and located at 25 Courtland Street NE, at the intersection of Edgewood Avenue and Courtland Street, in the heart of the City’s academic, philanthropic, and community outreach districts; and 

WHEREAS, Georgia State University (“GSU”), an institution within the University System of Georgia, has a student body of over 30,000 people, a faculty and staff of over 3,000 people and a campus of buildings that surrounds the Park; and

WHEREAS, the Park is located in the center of GSU’s campus, is an asset to GSU, is heavily utilized by students for passive activity such as study and socializing and the Park is heavily programmed by GSU, its departments/units and officially recognized GSU student organizations; and

WHEREAS, in 2010, the City approved legislation that simplifies GSU’s ability to schedule events in the Park; and

WHEREAS, since 1992, GSU has been actively involved in the development, maintenance and enhancement of the Park to the benefit of GSU students and staff, the citizens of the City, and the City’s many visitors; and  the City wishes to enter into a Memorandum of Understanding (“MOU”) with the Board of Regents of the University System of Georgia (“BOR”), by and on behalf of GSU, to facilitate GSU’s use and improvement of the Park by creating a cooperative relationship with GSU; and

WHEREAS, the term of the MOU shall be five (5) years with one (1) five (5) year renewal option by mutual consent of the parties; and

 

WHEREAS, it is in the best interest of the City to enter into a MOU with BOR, by and on behalf of GSU, to define the cooperative relationship between the parties, and to establish the role and obligations of each party in that relationship. 

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Mayor is authorized, on behalf of the City, to enter into a MOU with the Board of Regents of the University System of Georgia, by and on behalf of Georgia State University, regarding the roles and obligations of each of the parties in the development, maintenance, and enhancement of the Park, and said MOU shall at a minimum provide for the following:

a)              The City, as owner of the Park, shall have authority to make all final decisions regarding the Park, but shall exercise its authority in the spirit of good faith cooperation with GSU;

b)              GSU shall have the authority and the responsibility to develop, maintain, and enhance the Park in a manner consistent with the MOU;

c)              GSU shall have the authority to provide programming in the Park in a manner consistent with the MOU;

d)              GSU  shall have the  authority and primary responsibility for raising additional funds for the Park, and for overseeing the use of the funds it raises, making certain that the funds are utilized consistent with the MOU; and

e)              The term of the MOU shall be five years with an option of one five-year renewal upon mutual agreement of the parties.

BE IT FURTHER RESOLVED, that the City Attorney is hereby directed to prepare the MOU for execution by the Mayor, and the MOU shall be approved as to form by the City Attorney.

BE IT FINALLY RESOLVED, that the MOU shall not become binding upon the City, and the City shall incur neither obligation nor liability thereunder, until the same has been signed by the Mayor and delivered to GSU.
