AN ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE TO WAIVE THE SOURCE SELECTION AND PAYMENT PROVISIONS CONTAINED IN THE CITY OF ATLANTA CODE OF ORDINANCES, ARTICLE X, PROCUREMENT AND REAL ESTATE CODE, TO PAY OUTSTANDING INVOICES FOR EMERGENCY PROCUREMENT C-1041 WITH PIONEER TECHNOLOGY GROUP, LLC, IN AN AMOUNT NOT TO EXCEED TWENTY THOUSAND, TWO HUNDRED TWENTY-FIVE DOLLARS AND ZERO CENTS ($20,225.00); ALL CONTRACTED WORK TO BE CHARGED TO AND PAID FROM FUNDING NUMBERS LISTED HEREIN; AND FOR OTHER PURPOSES.

Body

WHEREAS, on March 22, 2018, the City of Atlanta (“City”) experienced a ransomware cyberattack that encrypted City data, affected multiple City applications and devices, and resulted in a City-wide technology outage (the “Cyberattack”); and

 

WHEREAS, the Chief Procurement Officer authorized Emergency Procurement C-1041 with Pioneer Technology Group, LLC (“Pioneer”) in an amount not to exceed One Hundred Twenty-Four Thousand Two Hundred Fifty Dollars and Zero Cents ($124,250.00); and

 

WHEREAS, due to the dynamic nature of the cyberattack response, Pioneer performed additional necessary services that exceeded the approved emergency Purchase Order (“P.O.”) amount.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS, as follows:

 

SECTION 1:  That the Mayor or her designee is now authorized to pay outstanding invoices for Emergency Agreement Number C-1041 with Pioneer Technology Group, LLC (“Pioneer”) for Pioneer Technology Group Benchmark Case Management System in an amount not to exceed Twenty Thousand Two Hundred Twenty-Five Dollars and Zero Cents ($20,225.00).

 

SECTION 2:  That all contracted work shall be charged to and paid from the following Fund, Department Organization, Account, and Function Activity (“FDOA”) numbers:

 

1001 (General Fund) 050201(AIM IT Security) 5212001 (Consulting/Professional Services) 1535000 (Data Processing/Management Information System).

 

SECTION 3: Section 2-1187 of Article X of the Procurement and Real Estate Code of the City of Atlanta Code of Ordinances is waived to the extent of any conflict with this Ordinance.
