AN ORDINANCE BY TRANSPORTATION COMMITTEE TO ESTABLISH THE LINDBERGH/ARMOUR MASTER PLAN UPDATE STUDY PROJECT BY AMENDING THE FISCAL YEAR 2019 GENERAL FUND AND CAPITAL PROJECTS FUND BY TRANSFERRING APPROPRIATIONS IN AN AMOUNT NOT TO EXCEED TWO HUNDRED FIFTY THOUSAND DOLLARS AND ZERO CENTS ($250,000.00) AND TO AUTHORIZE THE MAYOR OR HER DESIGNEE, TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH AND RECEIVE AN AMOUNT NOT TO EXCEED ONE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($100,000.00) FROM THE METROPOLITAN ATLANTA RAPID TRANSIT AUTHORITY (MARTA) FOR A TOTAL PROJECT COST NOT TO EXCEED THREE HUNDRED FIFTY THOUSAND DOLLARS AND ZERO CENTS ($350,000.00); ALL COSTS SHALL BE CHARGED TO AND PAID FROM ACCOUNTS LISTED HEREIN; AND FOR OTHER PURPOSES.

Body

WHEREAS, the Metropolitan Atlanta Rapid Transit Authority (“MARTA”) is the entity responsible for the development and operation of mass transit service for the City of Atlanta as well as Fulton, DeKalb, and Clayton Counties; and

WHEREAS, the City of Atlanta and MARTA desire to enter into an agreement to conduct a study that will provide a framework for the integration of multi-modal transportation options including, transit, trails, bicycle infrastructure, and sidewalks as well as a strategy for the provision of affordable housing, mixed-use development, and an overall branding and placemaking concept for the Lindbergh-Armour Study area (hereinafter referred to as the "Project"); and

WHEREAS, the Project study area includes the potential junction between the light rail services proposed for the Clifton Corridor and BeltLine as well as the South Fork Trail, PATH 400, Peachtree Creek Greenway, and BeltLine Northeast Trail section; and 

WHEREAS, on October 22, 2018, MARTA provided a letter of commitment indicating a financial contribution to the Department of City Planning for the development of and successful execution of the Lindbergh-Armour Major Plan Update in an amount not to exceed one hundred thousand dollars and zero cents ($100,000) (“Exhibit A”); and

WHEREAS, the City of Atlanta Department of City Planning has budgeted an amount not to exceed two hundred fifty thousand dollars and zero cents ($250,000) to contribute to the overall project cost of three hundred fifty thousand dollars and zero cents ($350,000); and

WHEREAS, the City of Atlanta and MARTA agree that the Department of City Planning will manage the planning and development of the Lindbergh-Armour Major Plan Update study.

 

NOW THEREFORE THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA

HEREBY Ordains as follows:

Section 1: The Mayor or her designee, on behalf of the City of Atlanta, is authorized to execute an Intergovernmental Agreement (“IGA”) in substantially the form attached as "Exhibit B" hereto, between MARTA and the City of Atlanta for the development of the Lindbergh-Armour Major Plan Update study, and to authorize the City of Atlanta to receive a financial contribution from MARTA in the amount of one hundred thousand dollars and zero cents ($100,000) in support of the Project.

Section 2: that said IGA shall not become binding on the City and the City shall incur no liability upon same until such IGA has been approved by the City Attorney as to form, executed by the Mayor, or her designee, attested to by the Municipal Clerk, and delivered to MARTA.

Section 3: that all charges are to be paid from the account stream as follows: 3503 (Capital Projects Fund), 250441 (DCP Director of Mobility), 5212001 (Consulting and Professional Services, 7410000 (Planning and Zoning), 25213283 (Lindbergh-Armour Master Plan Update), 350352538 (Lindbergh-Armour Master Plan Update) - $100,000 and 3503 (Capital Projects Fund), 250441 (DCP Director of Mobility), 5212001 (Consulting and Professional Services, 7410000 (Planning and Zoning), 25213283 (Lindbergh-Armour Master Plan Update), 350392542  - $250,000.

Section 4: that the Chief Financial Officer is authorized to amend the Fiscal Year 2019 Budget shall be amended in the amount of one hundred thousand dollars and zero cents ($100,000) as follows:
