AN ORDINANCE BY COUNCILMEMBERS HOWARD SHOOK AND JENNIFER N. IDE AMENDING CHAPTER 114 - PERSONNEL, ARTICLE IV-CIVIL SERVICE, DIVISION 3-PAY PLAN, TO THE CITY OF ATLANTA CODE OF ORDINANCES AND CREATING A NEW SECTION 114-143 ESTABLISHING A PROCEDURE FOR AWARDING PERFORMANCE BONUSES; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta is dedicated to providing the highest level of service and service delivery to Atlanta taxpayers and to commuters, tourists, and other visitors; and

 

WHEREAS, the City of Atlanta provides such services and service delivery through its employees' effective performance of their duties; and

 

WHEREAS, some City employees go above and beyond the call of duty to ensure that the City maintains the highest level of service and service delivery; and

 

WHEREAS, exceptional performance by employees results in a greater benefit to taxpayers and general public and helps the City be a better steward of tax dollars through improved efficiency in the delivery of City services; and

 

WHEREAS, in both the public and private sector, institutions and businesses recognize and reward employees for such exceptional service through the provision of incentives, including additional monetary compensation; and

 

WHEREAS, such incentives have been effective in encouraging employees to perform at exceptional levels with the positive result of cost savings through more effective and more efficient service delivery; and

 

WHEREAS, performance bonuses induce employees to remain in public service; and

 

WHEREAS, the Mayor and City Council are of the opinion that such an incentive program that is based upon a direct public benefit of greater efficiency and effectiveness in service delivery and resultant cost savings would be of value to the City and its citizens; and

 

WHEREAS, it is the intent of the Mayor, City Council, and the Council President that any such incentives be paid from savings of funds otherwise allocated in the City budget, and therefore be budget neutral.

 

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS AS FOLLOWS:

 

SECTION 1: That Chapter 114- Personnel, Article IV.-Civil Service, Division 3.-Pay Plan, to the City of Atlanta Code of Ordinances, is hereby amended to add the following section (additions shown in bold type): 2

 

Section 114-143. Performance Bonus.

 

1. The Mayor, City Council, and President of Council are granted the authority to pay their respective employees an annual performance bonus as follows:

 

a. The payment of bonuses shall be paid from any excess funds in the operating budget allocated to that department, and shall be prospective.

 

b. The Mayor or designee, Council Members, and Council President shall establish specific guidelines and eligibility criteria to govern the award of bonuses to their respective employees that is based upon a defined benefit to the public for which the bonuses may be awarded. Once the guidelines are established, the Mayor or designee, each  Council  member, and  the Council  President shall  have  the discretion to determine the actual awarding of bonuses and shall disseminate such guidelines to their respective employees upon hiring and at the time that any yearly performance or compensation review for such employees takes place.
 

i. The guidelines should include, but are not limited to, the following: (1) the

criteria under which employees are eligible to receive a bonus; and (2) the specific method in which employees will be selected to be awarded a bonus.


ii. With  respect  to the employees of the Executive  Branch, performance

bonuses may only be awarded to full-time City employees.

 

c. No bonus  may be awarded to an employee for merely satisfactorily performing the assigned duties that are expected in return for the employee's regular salary. Rather, bonuses  may be awarded for exceptional or exemplary service rendered by an employee for service that is outside of and in addition to the normal duties and responsibilities of his or her position.

 

d. The performance bonus shall not be considered in determining an employee's rate of pay or award of overtime.

 

e. No employee may receive more than one performance bonus per year, and no employee may receive a performance bonus payment in a gross amount above ten percent (10%) of the employee's annual base salary. Such performance bonuses shall be paid in accordance with normal payroll practices, including appropriate payroll deductions.

 

f. Prior to the award of performance bonuses in a specific department, the Chief

Financial Officer shall certify that sufficient funds are available for that department. g. The Chief Financial Officer shall prepare an annual report of all bonus payments.

h. This performance bonus shall not be considered in computing an employee's pension entitlement.

 

i. This ordinance is intended to govern the payment of performance bonuses and shall not impact other bonuses otherwise expressly authorized.

 

SECTION 2: That the amendments in this ordinance shall become effective immediately upon adoption and approval.

 

SECTION 3: That if any provision, clause, sentence or paragraph of this ordinance, or the application thereof to any person or circumstances, shall be held invalid, such invalidity shall not affect the other provisions or application of the provisions of this ordinance which can be given effect without the invalid provisions or application and, to this end, the provisions of this ordinance are hereby declared to be severable.
