A RESOLUTION BY COUNCILMEMBER JOYCE M. SHEPERD AS AMENDED BY COMMUNITY DEVELOPMENT/HUMAN SERVICES COMMITTEE AUTHORIZING THE MAYOR OR HER DESIGNEE TO ENTER INTO A CONTRACTUAL AGREEMENT WITH SYNERGY REAL ESTATE DEVELOPERS, LLC. IN AN AMOUNT NOT TO EXCEED ONE HUNDRED AND NINE THOUSAND EIGHT HUNDRED AND THIRTY-THREE DOLLARS AND ZERO CENTS ($109,833.00); AND FOR OTHER PURPOSES.

Body

WHEREAS, the Fulton County/City of Atlanta Land Bank Authority issued a Request for Qualifications for Developers interested in developing properties for affordable housing within their portfolio in which Synergy Real Estate Developers, LLC; S&L Renovations, LLC; National Property Institute, LLC; Atlanta Neighborhood Development Partnership, Inc.; and Jewel of the South Inc. was approved by their board to meet the requirements to be a part of their Qualified Developer Pool in April2017; and

 

WHEREAS, the Fulton County/City of Atlanta Land Bank Authority issued a Request for Proposals for twenty-two (22) properties to the Qualified Developer Pool, and in which Synergy Real Estate Developers, LLC was selected by their board as the successful winner of nineteen (19) properties in October 2017 and March 2018; and

 

WHEREAS, Synergy Real Estate Developers, LLC has requested HOME funds to fill their funding gap to sell a single-family home located in the Pittsburgh neighborhood to households below 80% Area Median Income (AMI); and

 

WHEREAS, pursuant to the regulations to commit HOME funds, the Department of City Planning, Office of Housing and Community Development has ensured that 1) All necessary financing has been secured; 2) A budget and schedule has been established; 3) Construction is scheduled to start within 12 months; 4) The experience and financial capacity of the developer has been evaluated; and 5) An underwriting and subsidy layering analysis has been competed; and

 

WHEREAS, the Department of City Planning, Office of Housing and Community Development recommends entering into a HOME contractual agreement for a term not to exceed eighteen (18) months with Synergy Real Estate Developers, LLC in an amount not to exceed One Hundred and Nine Thousand, Eight Hundred and Thirty-Three Dollars and No Cents ($109,833.00).

 

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES, that the Mayor or her designee is authorized to execute a contract agreement with Synergy Real Estate Developers, LLC in an aggregate amount not to exceed a total of One Hundred and Nine Thousand, Eight Hundred and Thirty-Three Dollars and No  Cents ($109,833.00) for a term not to exceed eighteen months (18) months according to the following:

BE IT FURTHER RESOLVED, that the City Attorney or her designee is authorized to prepare the appropriate contract agreements for execution by the Mayor or her designee, to be approved by the City Attorney or her designee as to form.

 

BE IT FINALLY RESOLVED, that the contract agreements with the contracting party shall not become binding on the City and the City shall not incur any liability until such time as the contract has been signed by the Mayor or her designee and delivered to the contracting party.
