SPECIFICALLY NAMING THE CUSTODIANS OF
RECORDS AND OPEN RECORDS COORDINATORS WITHIN THE CITY
OF ATLANTA FOR THE PURPOSES OF THE GEORGIA OPEN
RECORDS ACT, O.C.G.A. § 50-18-71(b)(1)(B) AND O.C.G.A. § 50-18-
71(b)(2) AND IN ACCORDANCE WITH ATLANTA CITY CODE SECTION
3-3(A); AND FOR OTHER PURPOSES.

WHEREAS, the City of Atlanta (the "City"), a municipal corporation within the State of Georgia, is subject to the requirements of the Georgia Open Records Act (O.C.G.A. §so-18-70, et seq.) (the "Georgia Open Records Act"); and

 

WHEREAS, the City's full compliance with the requirements of the Georgia Open Records Act is a vital and essential component of creating and maintaining public trust and enhancing the City's effectiveness; and

 

WHEREAS, the City intends to implement a comprehensive plan for best in class policies, procedures, and protocols for transparency and compliance with the Georgia Open Records Act; and

 

WHEREAS, the City has created a new chapter in the City of Atlanta Code of Ordinances, "Chapter 3- Transparency"; and

 

WHEREAS, the newly enacted City of Atlanta Code Section 3-3 officially designates the head of each city department, office, bureau or similar entity as the official custodian of that entity's records for the purposes of compliance with the requirements of the Georgia Open Records Act and authorizes each so designated official records custodian, along with the Mayor and President of Council, to designate a person or persons within their respective department, office, bureau or similar area of purview, as an open records coordinator whose responsibility it shall be to receive and respond to requests for public records with the assistance and oversight of the transparency officer; and

 

WHEREAS, the City of Atlanta has specifically identified the records custodian and the open records coordinator(s) for each city department, office, bureau or similar entity, the Mayor's Office and the City Council pursuant to the  requirements of the Georgia Open Records Act, O.C.G.A. Section so-18-71(b)(1)(B), for the purpose of directing open records requests to the department, office, bureau or similar entity most equipped to respond to said requests; and

 

WHEREAS, the City of Atlanta has compiled a list of the records custodians and the open records coordinators for each city department, office, bureau or similar entity, the Mayor's Office and the City Council, that includes the first and last name, email address, efacsimile number and telephone number to which open records requests should be directed, a copy of which is attached to this Resolution as Exhibit A.

 

NOW, THEREFORE, BE IT RESOLVED  BY THE COUNCIL OF THE CITY OF ATLANTA, as follows:

 

SECTION 1: That the Municipal Clerk is requested to publish the list of records custodians and open records coordinators for each city department, office, bureau or similar entity, the Mayor's Office and the City Council, which is attached as Exhibit A, in compliance with the requirements of the Georgia Open Records Act, O.C.G.A. Section 50-18-71(b)(2), in the Daily Report, the legal organ of Fulton County, and the Champion Newspaper, the legal organ of DeKalb County; and

 

SECTION 2: That the Chief Information Officer, with the support of all necessary personnel, is directed to add an "Open Records" banner to the City of Atlanta's website, to add an "Open Records" banner to the Atlanta City Council's website, to add an "Open Records" link in the header of all City of Atlanta websites that is visible on all pages of those websites, including (but not limited to) the City of Atlanta's website and the Atlanta City Council's website, that the directs the user to the list of records custodians and open records coordinators for each city department, office, bureau or similar entity, the Mayor's Office and the City Council, which list is attached as Exhibit A, in compliance with the requirements of the Georgia Open Records Act, O.C.G.A. Section so-18-71(b)(2); and

 

SECTION 3: That the transparency officer is directed:

 

(1) to update the list of records custodians and open records coordinators for each city department, office, bureau or similar entity, the Mayor's Office and the City Council, at a minimum bi-annually to insure the information is current; and

(2) to, each time the list is updated, provide the updated list to the Municipal Clerk for

publication in the legal organs for Fulton and DeKalb counties, in compliance with the requirements of the Georgia Open Records Act, O.C.G.A. Section so-18-71(b)(2); and

(3) to, each time the list is updated, provide the updated list to the Chief Information Officer for updating of the City of Atlanta and Atlanta City Council websites, in compliance with

the requirements of the Georgia Open Records Act, O.C.G.A. Section so-18-71(b)(2); and

 

SECTION 4: That all requests for records made under the Georgia Open Records Act shall be made directly to the appropriate city department, office, bureau or similar entity by submitting such request to the designated records custodian or records coordinator(s) via the dedicated email address, efacsimile number or telephone number;

 

SECTION 5: That the requirement that all requests for records received by the city, along with the records provided to each requester, be uploaded to the city's open records website shall be stayed until that website has become operational.

 

SECTION 6: That all resolutions or Code sections, or parts thereof, in conflict with the provisions of this resolution are hereby waived only to the extent of the conflict.

 

SECTION 7: This resolution shall become effective immediately upon its adoption by the Atlanta

City Council and its approval by the Mayor.
