AN AMENDED ORDINANCE
BY FINANCE/EXECUTIVE COMMITTEE
AUTHORIZING THE MAYOR OR HER DESIGNEE, FOR A PERIOD OF FIVE (5) YEARS FROM THE EFFECTIVE DATE OF THIS ORDINANCE, TO EXECUTE LEASE AGREEMENTS FOR THE RENTAL OF OFFICE SPACE AT 818 POLLARD BOULEVARD, SW FOR THE RENTAL OF OFFICE SPACE FOR A TERM OF THREE (3) YEARS EACH, WITH PUBLIC AND PRIVATE ENTITIES THAT PROVIDE VALUABLE SERVICES TO THE SURROUNDING COMMUNITIES; TO IMPLEMENT A RENTAL RATE AT $11.00 PER RENTABLE SQUARE FOOT FOR SUCH LEASES; ALL LEASING REVENUES TO BE DEPOSITED INTO THE TRUST FUND ACCOUNT SET FORTH HEREIN; AUTHORIZING THE EXPENDITURE OF SUCH TRUST FUNDS FOR THE RENOVATION AND REMODELING OF THE FACILITY; WAIVING THE PROVISIONS OF SECTION 2-1547 OF THE CITY OF ATLANTA CODE OF ORDINANCES REQUIRING A REQUEST FOR LEASE PROPOSAL AND ANNUAL REVISION OF RENTAL RATES; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”) owns and operates the building located at 818 Pollard Boulevard, SW (the “Facility”); and

 

WHEREAS, the Facility is primarily occupied by City employees from multiple departments performing administrative tasks; and

 

WHEREAS, several public and private entities also occupy office space at the Facility for operations and administrative purposes, and those entities provide valuable and important services to the surrounding community while generating revenue for the City from rental fees; and

 

WHEREAS, the Department of Enterprise Assets Management (“DEAM”) is experienced at performing real estate management services to include operations, maintenance, and repair, and now performs those services at the Facility as it does at the John C. Birdine Neighborhood Service Center, Dunbar Neighborhood Service Center, and Georgia Hill Neighborhood Service Center (the “Centers”) owned by the City; and

 

WHEREAS, DEAM also enters into lease agreements with tenants in its reasonable discretion at the Centers as authorized by City Council Ordinance 17-O-1134 on April 17, 2017; and

 

WHEREAS, given the costs associated with managing the Facility, it is more efficient to allow DEAM to perform the same duties at the Facility as it does at the Centers, including the selection of prospective tenants of the Facility and the negotiation of the terms of each lease at the Facility, rather than undertaking a request for lease proposals for each individual lease; and

 

WHEREAS, the Chief Procurement Officer recommends allowing DEAM in its reasonable discretion to select prospective tenants of the Facility and to negotiate the terms of each lease at the Facility, and for the Mayor to have authorization for a period of five (5) years from the effective date of this Ordinance to execute such lease agreement without the need for other or further authorization by City Council, requests for lease proposals, or annual revision of rental rates; and

 

WHEREAS, Ordinance 17-O-1134 sets a rate of $11.00 per rentable square foot for the lease of office space at the Centers and a late payment fee of $25.00 for the leases at the Centers; and

 

WHEREAS, the Chief Procurement Officer, after consultation with DEAM, recommends setting a rental rate and late fee at the Facility at the same amount as at the Centers since the rental space is comparable at each location; and 

 

WHEREAS, all revenue generated from the leased office space at the Facility shall be deposited in newly establishment of trust fund account strings for the Department of Enterprise Assets Management associated with 818 Pollard Boulevard, SW.

 

WHEREAS, all expenses generated from leased office space at the Facility shall be expended from newly established DEAM trust account strings for the general maintenance and upkeep of the Facility;

 

THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS AS FOLLOWS:

 

Section 1: That DEAM shall exercise reasonable discretion in negotiating for the lease of office space in the Facility with public and private entitles that will provide valuable services to the Community surrounding the Facility.

 

Section 2: The Mayor or her designee is hereby authorized, for a period of five (5) years from the effective date of this Ordinance, to execute lease agreements and any related documents or agreements necessary for the rental of office space at the Centers at the recommendation of DEAM, without other or further authorization by City Council and without the need for requests for lease proposals or annual revision of rental rates, with the term of each such lease not to exceed three (3) years at the rates established herein.

 

Section 3: The provisions of the City of Atlanta Code of Ordinances Section 2-1547 requiring request for lease proposals, annual revision of rental rates, and further authorization by City Council for each lease, are hereby waived in connection with this Ordinance only.

 

Section 4: The rental rate for the lease of office space at the Facility is set at $11.00 per rentable square foot for all leases entered after the date that is thirty (30) days after the effective date of this Ordinance.

 

Section 5: The $25.00 late fee for leases of office space at the Facility is authorized.


Section 6: The Chief Financial Officer is hereby authorized to establish trust fund account strings for the Department of Enterprise Assets Management to accept revenues associated with office space leased at 818 Pollard Boulevard, SW:

 

7701 (Trust Fund), 310401 (General Buildings & Plants), 3810008 (Building Rentals), 1565000 (Gen. Gov’t. -Bldgs. & Plants), 600410 (818 Pollard Boulevard), 69999 (Funding Source).

 

Section 7: In the event that the City disposes of its right, title, and interest in the building located at 818 Pollard Boulevard, SW, then the General Fund account shall receive any residual proceeds in the trust fund account strings for the Department of Enterprise Assets Management associated with office space leased at 818 Pollard Boulevard, SW.

 

Section 8: DEAM shall receive all rental revenue from leasing at the Facility, and shall deposit fifty percent (50%) of that revenue into the follow trust fund accounts:

 

1001 (General Fund), 310401 (General Buildings & Plants), 3810008 (Building Rentals), 1565000 (Gen. Gov’t. -Bldgs. & Plants), Project 600410, 69999 (Funding Source). 

 

Section 9: DEAM shall deposit the remaining fifty percent (50%) of such revenue into the following General Fund account:

 

1001 (General Fund), 310401 (General Buildings & Plants), 3810008 (Building Rentals), 1565000 (Gen. Gov’t.-Bldgs. & Plants)

 

Section 10: DEAM is hereby authorized to use the revenues deposited in the trust fund account for the Facility for general maintenance, upkeep, renovations, and remodeling at the Facility.

Section 11: The City Attorney or her designee is hereby directed to draft or review and approve as to form each lease agreement prior to execution by the Mayor.

 

Section 12: That no lease agreement shall become binding on the City and the City shall incur no obligation or liability under the same until such lease agreement has been executed by the Mayor, attested by the Municipal Clerk, approved by the City Attorney or her designee as to form, and delivered to the tenant.

 

Section 13: That all ordinances and parts of ordinances in conflict therewith are repealed, but only to the extent of the conflict.
