AN AMENDED ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR TO ENTER INTO AMENDMENT NO. 5 WITH ROCKDALE PIPELINE, INC./INTEGRAL MUNICIPAL SERVICES CORP., JV FOR FC-7163, ANNUAL CONTRACT FOR LARGE WATER METER INSTALLATION, ON BEHALF OF THE DEPARTMENT OF WATERSHED MANAGEMENT, IN AN AMOUNT NOT TO EXCEED THREE MILLION DOLLARS AND ZERO CENTS ($3,000,000.00); TO EXTEND THE TERM OF THE AGREEMENT ON A MONTH-TO-MONTH BASIS FOR A PERIOD NOT TO EXCEED SIX (6) MONTHS EFFECTIVE JUNE 24, 2019 THROUGH DECEMBER 23, 2019; TO WAIVE THE COMPETITIVE SOURCE SELECTION REQUIREMENTS CONTAINED IN SECTION 2-1187 OF ARTICLE X PROCUREMENT AND REAL ESTATE CODE OF THE CITY OF ATLANTA CODE OF ORDINANCES; ALL CONTRACTED WORK SHALL BE CHARGED TO AND PAID FROM THE FUND DEPARTMENT ORGANIZATION AND ACCOUNT NUMBER LISTED; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”) authorized FC-7163, Annual Contract for Large Water Meter Installation (“Agreement”) with Rockdale Pipeline, Inc./Integral Municipal Services Corp., JV on behalf of the Department of Watershed Management, pursuant to Resolution No. 14-R-1372;

WHEREAS, the term of the Agreement is for one (1) year with two (2) one (1) year renewal options to be exercised at the City’s sole discretion, effective September 23, 2014 through September 22, 2015;

WHEREAS, the City authorized Renewal No. 1 of the Agreement with a term of September 23, 2015 through September 22, 2016, pursuant to Resolution No. 15-R-4064;

WHEREAS, the City authorized a ninety (90) day extension that extended the term of the Agreement to December 22, 2016;

WHEREAS, the City authorized Renewal No. 2 of the Agreement with a term of December 23, 2016 through December 22, 2017, pursuant to Resolution No. 16-R-4594;

WHEREAS, the City authorized Amendment No. 1 to add funding for additional large water meter installations in an amount not to exceed Five Million, Five Hundred Thousand Dollars and Zero Cents ($5,500,000.00), pursuant to Resolution No. 17-R-3516;

WHEREAS, the City authorized Amendment No. 2 to extend the term of the Agreement on a month-to-month basis for a period not to exceed six (6) months in an amount not to exceed Six Million Dollars and Zero Cents ($6,000,000.00), pursuant to Ordinance No. 17-O-1687;

WHEREAS, the City authorized Amendment No. 3 to extend the term of the Agreement on a month-to-month basis for a period not to exceed six (6) months, pursuant to Ordinance No. 18-O-1329;

WHEREAS, the City authorized Amendment No. 4 to extend the term of the Agreement on a month-to-month basis for a period not to exceed (6 months) in an amount not to exceed Seven Million Dollars and Zero Cents ($7,000,000.00) pursuant to Ordinance No. 18-O-1728;

WHEREAS, Rockdale Pipeline, Inc./Integral Municipal Service Corp., JV continues to satisfactorily perform services under the Agreement; and

WHEREAS, the Commissioner of the Department of Watershed Management recommends Amendment No. 5 with Rockdale Pipeline, Inc./Integral Municipal Services Corp., JV for FC-7163, Annual Contract for Large Water Meter Installation, on behalf of the Department of Watershed Management, in an amount not to exceed Three Million Dollars and Zero Cents ($3,000,000.00); to extend the term of the Agreement on a month-to-month basis for a period not to exceed six (6) months effective June 24, 2019, with the option to terminate at any time during the six (6) month period conditioned upon the City giving Rockdale Pipeline, Inc. Integral Municipal Services Corp., JV thirty (30) days written notice of any said early termination

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS as follows:

SECTION 1: That the Mayor, or her authorized designee, is authorized to enter into Amendment No. 5 for FC-7163, Annual Contract for Large Water Meter Installation with Rockdale Pipeline, Inc./Integral Municipal Services Corp., JV, on behalf of the Department of Watershed Management, to extend the term of the Agreement  on a month-to-month basis for a period not to exceed six (6) months, for time only effective June 24, 2019, with the option to terminate at any time during the six (6) month period conditioned upon the City giving Rockdale Pipeline, Inc./Integral Municipal Services Corp., JV thirty (30) days written notice of any said early termination.

SECTION 2: That Section 2-1187 of Article X of the Procurement and Real Estate Code of the City of Atlanta Code of Ordinances, specifically including and without limitation, “Division 4, Source Selection and Contract Formation” is hereby waived to the extent applicable to meet the intent and purpose of this ordinance.

SECTION 3: That the Chief Procurement Officer, in consultation with the City Attorney, is directed to prepare all appropriate documents for execution by the Mayor, or her authorized designee.

SECTION 4: That all contracted work will be charged to and paid from the Fund Department Organization and Account Number 5077 (2018 Commercial Paper Proceeds) 171005 (DWM Infrastructure Appurtenance) 5999999 (Projects and Grants Budget) 4410000 (Water Administration) and Project Task Award Expenditure and Organization Number 17102664 (Repair and Replace Large Water Meters) 108 (FY 2020) 50778520 (2018 Commercial Paper Proceeds) 5414002 (Facilities Other Than Buildings) COA.
