A RESOLUTION BY COUNCILMEMBER MICHAEL JULIAN BOND AS AMENDED BY TRANSPORTATION COMMITTEE AUTHORIZING THE MAYOR OR HER DESIGNEE TO ISSUE TASK ORDER NUMBER 3 TO SOCO-TEM,JV., FOR FC-8250, CONTRACT FOR THE MAINTENANCE AND REPAIR OF SIDEWALKS, CURBS, DRIVEWAY APRONS & ASSOCIATED INFRASTRUCTURE, FOR SIDEWALK REPAIRS, IN AN AMOUNT NOT TO EXCEED ONE MILLION DOLLARS AND ZERO CENTS ($1,000,000.00) ON BEHALF OF THE DEPARTMENT OF PUBLIC WORKS; ALL CONTRACTED WORK TO BE CHARGED TO AND PAID FROM VARIOUS FUND, DEPARTMENT, ORGANIZATION AND ACCOUNT NUMBERS LISTED HEREIN; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta ("City") did solicit Bids for Contract Number FC-8250, Contract for Maintenance and Repair of Sidewalks, Curbs, Driveway Aprons & Associated Infrastructure ("Agreement"); and

 

WHEREAS, Resolution 16-R-3264, adopted by the Atlanta City Council on March 21, 2016 and approved operation of law on March 30, 2016, authorized the City to enter into the Agreement with SoCo-TEM, JV in an amount not to exceed Four Million Eight Hundred Forty-One Thousand Two Hundred Fifty Dollars and Zero Cents ($4,841,250.00); and

 

WHEREAS, the base term of the Agreement is for two (2) years, with the option to renew for

three (3) additional one (1) year periods; and

 

WHEREAS, Resolution 16-R-4365, adopted by the Atlanta City Council on October 3, 2016 and approved by operation of law on October 12, 2016, authorized the City to enter into Amendment Number 1 to the Agreement for sidewalk repairs in an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00); and

 

WHEREAS, Resolution 17-R-3874, adopted by the Atlanta City Council on July 5, 2017 and approved by operation of law on July 14, 2017, authorized the issuance of Task Order Number 1 for sidewalk repairs in an amount not to exceed Five Hundred Thousand Dollars and Zero Cents ($500,000.00).

 

WHEREAS, Resolution 18-R-3553, adopted by the Atlanta City Council on May 21, 2018 and approved per operation of law on May 30, 2018, authorized the City to enter into Renewal Number 1 to the Agreement for sidewalk repairs; and

 

WHEREAS, Resolution 18-R-4054, adopted by the Atlanta City Council on September 4, 2018 and approved by operation of law on September 13, 2018, authorized the City to issue a task order in an amount not to exceed Eight Hundred Thousand Dollars and Zero Cents ($800,000.00)

 

WHEREAS, Resolution 19-R-3523, adopted by the Atlanta City Council on May 6, 2019 and approved by operation of law on May 15, 2019, authorized the City to enter into Renewal Option Number 2; and

 

WHEREAS, SoCo-TEM, JV has performed the contracted services satisfactorily; and

 

WHEREAS, the Commissioner of the Department of Public Works and Chief Procurement Officer recommend this Task Order Number 3 for FC-8250, Contract for Maintenance and Repair of Sidewalks, Curbs, Driveway Aprons & Associated Infrastructure with SoCo-TEM, JV., for sidewalk repairs in an amount not to exceed One Million Dollars and Zero Cents ($1,000,000.00); and

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES, that the Mayor, or her designee, is authorized to issue Task Order Number 3 for FC-8250, Contract for Maintenance and Repair of Sidewalks, Curbs, Driveway Aprons & Associated Infrastructure with SoCo-TEM, JV., for sidewalk repairs in an amount not to exceed One Million Dollars and Zero Cents ($1,000,000.00);

 

BE IT FURTHER RESOLVED, that all contracted work shall be charged to and paid from FDOA: FY20 1001 (General Fund) 130306 (DPW Roadways & Walkways-North Avenue) 5212001 (Consulting/Professional) 4220000 (Roadways & Walkways).

 

BE IT FURTHER RESOLVED, that the Chief Procurement Officer is directed to assist the City Attorney in the preparation of the appropriate Task Order for execution by the Mayor, or her designee.

 

BE IT FINALLY RESOLVED, that Task Order Number 3 will not become binding upon the City, and the City shall incur no obligation or liability under it, until it has been approved by the City Attorney as to form, executed by the Mayor, attested to by the Municipal Clerk, and delivered to SoCo-TEM, JV.
