A RESOLUTION BY COUNCILMEMBERS CARLA SMITH AND HOWARD SHOOK AS AMENDED BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR OR HER DESIGNEE TO ENTER COOPERATIVE PURCHASING AGREEMENT NUMBER FC-1200014 WITH CDW GOVERNMENT, LLC., PURSUANT TO SECTION 2-1602 ET SEQ. OF THE CITY OF ATLANTA CODE OF ORDINANCES TO PURCHASE FORESCOUT ACTIVECARE ADVANCED IT SECURITY APPLIANCES EXTENDED SERVICE AGREEMENTS, UTILIZING CITY OF MESA, ARIZONA CONTRACT NUMBER 2018011-01, ON BEHALF OF THE DEPARTMENT OF ATLANTA INFORMATION MANAGEMENT FOR ONE (1) YEAR WITH THREE (3) REMAINING RENEWAL TERM OPTIONS, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-FOUR THOUSAND THREE HUNDRED TWENTY-TWO DOLLARS AND ZERO CENTS ($124,322.00), ALL CONTRACTED WORK TO BE CHARGED TO AND PAID FROM FUNDING NUMBERS LISTED HEREIN; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”) has a need for a Network Access solution that allows the City to quickly deploy unified device visibility and control agents across the City’s networks. ForeScout ActiveCare provides the City with license maintenance and timely, high-quality, technical support services; and

 

WHEREAS, pursuant to Article X, Division 15, Intergovernmental Relations, of the City of Atlanta Code of Ordinances (the “Code”), the Chief Procurement Officer may procure supplies, services or construction items through contracts established by a public procurement unit outside the City; and

 

WHEREAS, the Chief Procurement Officer certifies that organizational and personal relationships disclosed by the successful offeror have been considered in accordance with Atlanta City Code Section 2-1214 and that award of the contract is appropriate; and

 

WHEREAS, the Chief Procurement Officer has evaluated and determined that competitive procedures akin to those used by the city were used by the City of Mesa in the development of the contract from which the cooperative purchasing agreement will be derived and that the cost of the goods, supplies, services or construction are comparable to or less than the cost of the same goods, supplies, services or construction if obtained through city procurements under Division 4 of the City Procurement Code; and

 

WHEREAS, City of Mesa, Arizona Contract Number 2018011-01 for Information Technology Solutions and Services (“City of Mesa Contract Number 2018011-01”) remains in effect; and

 

WHEREAS, the Chief Information Officer now recommends entering into Cooperative Purchasing Agreement number FC-1200014 with CDW Government, LLC, to purchase ForeScout ActiveCare Advanced IT Security Appliances extended service agreements, in an amount not to exceed One Hundred Twenty-Four Thousand Three Hundred Twenty-Two Dollars and Zero Cents ($124,322.00); for a term of one (1) year, with three (3) one-year renewal term options.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Mayor or her designee is hereby authorized to enter into Cooperative Purchasing Agreement Number FC-1200014 with CDW Government, LLC (“CDWG”), utilizing City of Mesa, Arizona Contract Number 2018011-01 for Information Technology Solutions and Services to purchase ForeScout ActiveCare Advanced IT Security Appliances extended service agreements, in an amount not to exceed One Hundred Twenty-Four Thousand Three Hundred Twenty-Two Dollars and Zero Cents ($124,322.00); for a term of one (1) year, with three (3) one-year renewal term options.

 

BE IT FURTHER RESOLVED, that all costs are to be charged to and paid from the following Fund, Department Organization, Account, and Function Activity Code (“FDOA”) numbers:

BE IT FURTHER RESOLVED, that the Chief Procurement Officer, in consultation with the City Attorney is directed to prepare an agreement for execution by the Chief Procurement Officer or his designee.

 

BE IT FINALLY RESOLVED, that the agreement will not become binding upon the City, and the City will incur no obligation or liability under it, until it has been approved as to form by the City Attorney or her designee, executed by the Chief Procurement Officer or his designee, attested to by the Municipal Clerk, and delivered to CDWG.
