AN ORDINANCE BY COUNCILMEMBER J.P. MATZIGKEIT AS AMENDED BY FINANCE/EXECUTIVE COMMITTEE
TO AMEND CHAPTER 2 – ADMINISTRATION, ARTICLE X, PROCUREMENT AND REAL ESTATE CODE, DIVISION 4, SOURCE SELECTION AND CONTRACT FORMATION, SO AS TO CREATE A NEW SECTION 2-1190.1 TO MAKE PROVISIONS FOR MICRO-PUCHASES; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta’s Department of Procurement is charged with procuring supplies, construction, professional, real estate and consultant services for the City; and

 

WHEREAS, pursuant to Ordinance 15-O-1478 the Department of Procurement was consolidated to ensure that all purchasing and contracting activities are performed under the authority of the Department of Procurement to standardize procurement procedures, processes, and responsibilities, and decrease the duplication of procurement functions throughout the City; and

 

WHEREAS, the Chief Procurement Officer recognizes the need for flexibility to acquire low dollar value and commercially available goods or services; and

 

WHEREAS, a micro-purchase is one for goods or services that, due to its relatively low dollar value and commercial availability does not require adherence to Code section 2-1239, Maximum Practicable Competition; and

 

WHEREAS, the Chief Procurement Officer recommends an amendment to Article X, Division 4 of the City’s Procurement Code of Ordinances to create a new Code Section 2-1190.1

 

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA as follows:

 

SECTION 1: That Chapter 2 - Administration, Article X, Procurement and Real Estate Code, Division 4, Source Selection and Contract Formation of the City of Atlanta Code of Ordinances be amended by adding section 2-1190.1 entitled “Micro-Purchase”. Section 2-1190.1 shall read as follows:

Sec. 2-1190.1 - Micro-Purchases

(a)              General procedures. Any contract or purchase order for supplies and services, exclusive of set fees from the United States Postal Service, not exceeding $5,000.00 may be made in accordance with micro purchase procedures adopted by the Chief Procurement Officer in accordance with this article. Procurement requirements shall not be artificially divided so as to constitute either a small purchase or micro-purchase under this section.  Award shall be made to a fair and equitably priced vendor. The name of the business submitting a quotation, the date and amount of the quotation shall be recorded and maintained as public record. The aggregate amount of all micro-purchases for each department shall not exceed $5,000.00 per vendor, per fiscal year.

 

(b)  Authority of using agency. Heads of all city departments or their designee shall submit requisitions for micro-purchases to the Chief Procurement Officer or his designee for approval.  For such micro-purchases, no less than one business shall be solicited to submit a quotation.

(c)  Certification of unencumbered appropriation. Except for emergency procurements under section 2-1192, the Chief Procurement Officer shall not execute any contracts or purchase orders under this section until the Chief Financial Officer certifies, after pre-audit, that there is, to the credit of the user department concerned, a sufficient unencumbered appropriation balance, in excess of all unpaid obligations, to defray the amount of the order.

SECTION 2: The amendments contained in this ordinance shall be effective October 18, 2019.

 

SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby waived to extent of the conflict only.

Chairperson Shook requested Ordinance 19-O-1517 be removed from the Consent Agenda. Mr. Shook made a Motion to Amend the item to include the word "services" before supplies in the First Whereas clause and to revise language in Section 1(a) to state "set postage rates" from the United States Postal Service. It was Seconded by Council Member Matzigkeit and CARRIED by a roll call vote of 14 yeas; 0 nays. Following, Chairperson Shook made a Motion to Adopt as Amended. It was Seconded by Council Member Hillis and CARRIED by a roll call vote of 14 yeas; 0 nays.
