AN ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR TO ENTER INTO AMENDMENT NO. 2 WITH ELECTRICAL TESTING, INC., FOR FC-7093, ANNUAL CONTRACT FOR ELECTRICAL TESTING AND INSPECTION SERVICES, ON BEHALF OF THE DEPARTMENT OF WATERSHED MANAGEMENT, WAIVING THE COMPETITIVE SOURCE SELECTION REQUIREMENTS CONTAINED IN SECTION 2-1187 OF ARTICLE X PROCUREMENT AND REAL ESTATE CODE OF THE CITY OF ATLANTA CODE OF ORDINANCES TO EXTEND THE TERM OF THE AGREEMENT ON A MONTH-TO-MONTH BASIS FOR A PERIOD NOT TO EXCEED SIX (6) MONTHS WITH A RETROACTIVE EFFECTIVE DATE OF JULY 8, 2019 THROUGH JANUARY 7, 2020, FOR TIME ONLY, UNDER THE TERMS OF RESOLUTION NO. 15-R-3020; AND FOR OTHER PURPOSES.

WHEREAS, the City of Atlanta (“City”) authorized FC-7093, Annual Contract for Electrical Testing and Inspection Services (“Agreement”) with Electrical Testing, Inc., on behalf of the Department of Watershed Management, pursuant to Resolution No. 15-R-3020;

WHEREAS, the term of the Agreement is for two (2) years with two (2) one (1) year renewal options to be exercised at the City’s sole discretion, effective April 9, 2015 through April 8, 2017;

WHEREAS, the City authorized Amendment No. 1 to add funding for additional electrical testing and inspection services, in an amount not to exceed One Million, Nine Hundred Thousand Dollars and Zero Cents ($1,900,000.00), pursuant to Resolution No. 16-R-3402;

WHEREAS, the City authorized Renewal No. 1 of the Agreement with a term of April 9, 2017 through April 8, 2018, for time only, pursuant to Resolution No. 17-R-3322;

WHEREAS, the City authorized Renewal No. 2 of the Agreement with a term of April 9, 2018 through April 8, 2019, in an amount not to exceed Nine Hundred Seven Thousand Dollars and Zero Cents ($907,000.00), pursuant to Resolution No. 18-R-3304;

WHEREAS, the City authorized a ninety (90) day extension that extended the term of the Agreement to July 7, 2019;

WHEREAS, the Department of Watershed Management inadvertently allowed the contract to expire prior to executing a new Agreement to receive services;

WHEREAS, the Department of Watershed Management plans to resolicit and have a new contract executed within six (6) months;

WHEREAS, Electrical Testing, Inc. continues to satisfactorily perform services under the Agreement;

WHEREAS, the Commissioner of the Department of Watershed Management recommends entering into Amendment No. 2 with Electrical Testing, Inc. for FC-7093, Annual Contract for Electrical Testing and Inspection Services, on behalf of the Department of Watershed Management, to extend the term of the Agreement on a month-to-month basis for a period not to exceed six (6) months with a retroactive effective date of July 8, 2019 through January 7, 2020, for time only, under the terms of Resolution No. 15-R-3020.

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS as follows:

SECTION 1: That Section 2-1187 of Article X, Procurement and Real Estate Code of the City of Atlanta Code of Ordinances, specifically including without limitation, “Division 4, Source Selection and Contract Formation” is hereby waived to the extent applicable to meet the intent and purpose of this ordinance.

SECTION 2: That Electrical Testing, Inc. is authorized to provide and the City of Atlanta is authorized to accept electrical testing and inspection services on a month-to-month basis for a period not to exceed six (6) months with a retroactive effective date of July 8, 2019 through January 7, 2020, for time only, under the terms of Resolution No. 15-R-3020, with the option to terminate at any time during the six (6) month period conditioned upon the City giving Electrical Testing, Inc. thirty (30) days written notice of any said early termination.

SECTION 3:  That all ordinances or parts of ordinances in conflict with this ordinance, including but not limited to Section 2-1187 of the City of Atlanta Code of Ordinances, are hereby waived to the extent of the conflict.
