AN ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR OR HER DESIGNEE ON BEHALF OF THE CITY OF ATLANTA TO ENTER INTO A CONTRACT AMENDMENT TO CONTRACT FC-8875, WITH BIOHABITATS FOR THE PURPOSE OF PROVIDING PROFESSIONAL SERVICES IN DEVELOPING AN URBAN ECOLOGY FRAMEWORK, TO EXTEND THE CONTRACT TERM FOR A PERIOD OF TWELVE (12) MONTHS; AUTHORIZING THE CITY OF ATLANTA TO WAIVE THE COMPETITIVE PROCUREMENT PROVISIONS IN ARTICLE X, PROCUREMENT AND REAL ESTATE CODE, OF THE CITY OF ATLANTA CODE OF ORDINANCES; AND FOR OTHER PURPOSES.

WHEREAS, Resolution 17-R-3326 adopted by City Council June 19, 2017 and approved per City Charter Section 2-403 June 28, 2017 authorized by the Mayor to enter into FC-8875, Urban Ecology Framework, with Biohabitats, Inc. to provide professional services in developing an Urban Ecology Framework; and

 

WHEREAS, the term of Contract FC-8875, Urban Ecology Framework, with Biohabitats, Inc., expires on April 22, 2019; and

 

WHEREAS, the project was delayed due to the City’s cyber attack and the Mayoral transition; and

 

WHEREAS, in accordance with the terms of FC-8875, the Department of City Planning recommends entering into a contract amendment to extend the contract term for an additional twelve (12) months, with no change in funding or scope of work, in order to allow adequate time to meet the contract obligations.

 

The city council of the city of atlanta, georgia, hereby ordains:

 

SECTION 1: That the Mayor, or her designee, and the Chief Procurement Officer are authorized to enter into a contract amendment to contract FC-8875, Urban Ecology Framework, with Biohabitats, Inc., to extend the contract term for an additional twelve (12) months.

 

SECTION 2: that the Chief Procurement Officer, in consultation with the City Attorney, is hereby directed to prepare all appropriate documents for execution by the Mayor or her designee.

 

SECTION 3: that said contract amendment will not become binding on the City, and the City shall incur no liability or obligation under it until it has been approved as to form by the City Attorney or her designee, executed by the Mayor or her designee, attested to by the Municipal Clerk, and delivered to Biohabitats, Inc.

 

SECTION 4:  That all ordinances or parts of ordinances in conflict with this Ordinance, including but not limited to Code Section 2-1187, herewith be and the same are hereby waived to extent of the conflict only.
