AN ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE AMENDING THE FY2018 (INTERGOVERNMENTAL GRANT FUND) BUDGET, DEPARTMENT OF THE EXECUTIVE OFFICES, BY ADDING TO ANTICIPATIONS AND APPROPRIATIONS IN THE AMOUNT OF FIFTY THOUSAND DOLLARS AND ZERO CENTS ($50,000.00) ANNUALLY FOR TWO YEARS FROM CRIMINAL JUSTICE COORDINATING COUNCIL; AND WAIVING THE REQUIREMENTS OF CHAPTER 2, ARTICLE IX, DIVISION I, SECTION 2-910 OF THE CODE OF ORDINANCES OF THE CITY OF ATLANTA, GEORGIA, ENTITLED “GRANT APPLICATIONS”; AND RATIFYING THE MAYOR’S ACTIONS IN APPLYING FOR, ACCEPTING AND ENTERING INTO AGREEMENTS IN CONNECTION WITH THE CRIMINAL JUSTICE COORDINATING COUNCIL; AND FOR OTHER PURPOSES.

Body

 

WHEREAS, CJCC, (“CRIMINAL JUSTICE COORDINATING COUNCIL”) is an Executive Branch agency through the Georgia General Assembly, responsible for establishing a statewide body to unify that State’s diverse and interdependent criminal justice system; and

 

WHEREAS, CJCC created the Victims of Crime Act (VOCA) Assistance Grant Program to support agencies with direct services to crime victims; and

 

WHEREAS, the VOCA grants are awarded to agencies and organizations that perform direct services to victims of violent crimes; and

 

WHEREAS, the City of Atlanta’s (“City”) Mayor’s Office of Immigrant Affairs-Welcoming Atlanta (“Welcoming Atlanta”) builds upon Atlanta’s proud tradition of inclusion and welcoming by ensuring that immigrants and refugees are seamlessly integrated into the community and promoting a multicultural city that attracts families and business from around the world; and whereas this program will ensure that all crime victims’ rights, especially Limited English Proficient individuals, are upheld and protected in the criminal justice process; and

 

WHEREAS, Welcoming Atlanta is undertaking a comprehensive plan to assess, enhance, maintain, and sustain a proficient and culturally competent victim of crime assistance initiative that provides logistical and social service support; and

 

WHEREAS, Welcoming Atlanta has identified a significant need for a multi-lingual, civilian liaison to work with foreign-born and Limited English Proficient (LEP) victims of crime; and

 

WHEREAS, there is a nationwide decline in immigrant and LEP individuals reporting crimes to police; and

 

WHEREAS, Chapter 2, Article IX, Division 1, Section 2-910 of the Code of Ordinances of the City of Atlanta, Georgia (“Section 2-910”), subsection (a), requires that “any grant application which anticipates or proposes a contractual agreement that would bind the city to a particular project or contract … shall be approved before it is filed by resolution or ordinance…”; and 

 

WHEREAS, the grant application was due in November 2018, and Welcoming Atlanta was unable to seek council authorization prior to applying for the Grant. Welcoming Atlanta received an award letter on January 16, 2019; and 

 

WHEREAS, the City was awarded the Grant and the Fiscal Year 2018 Budget must be amended to anticipate and appropriate the grant funds.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS as follows:

 

SECTION 1:  That Section 2-910 is hereby waived and that the City’s actions are hereby ratified in applying for, accepting and executing any necessary documents in connection with the Grant.

 

SECTION 2:  That the Mayor is authorized to apply for, accept, and execute all documents associated with the Grant.

 

SECTION 3That the FY 2018 (Intergovernmental Grant Fund) Budget, Department of Executive Offices, be and is hereby amended as follows:

SECTION 4:              That the grant agreement will not become binding upon the City and the City will incur no obligation or liability under it, until it has been approved by the City Attorney as to form, executed by the Director of Welcoming Atlanta, attested by the Municipal Clerk, and delivered to CRIMINAL JUSTICE COORDINATING COUNCIL.

 

SECTION 5That all ordinances and parts of ordinances in conflict herewith are hereby waived for purposes of this ordinance only, and only to the extent of the conflict.
