A SUBSTITUTE (2) ORDINANCE BY COMMUNITY DEVELOPMENT/HUMAN SERVICES COMMITTEE AMENDING THE 2020 (COMMUNITY DEVELOPMENT FUND) BUDGET BY ADDING TO ANTICIPATIONS AND APPROPRIATIONS IN THE AMOUNT OF $7,156,340.00 FOR COMMUNITY BLOCK GRANT PROGRAM AND ADDING TO ANTICIPATIONS AND APPROPRIATIONS IN THE AMOUNT OF $627,336.00 FOR EMERGENCY SOLUTION GRANT AND BY AMENDING THE 2020 (HOME INVESTMENT TRUST FUND) BUDGET BY ADDING TO ANTICIPATIONS AND APPROPRIATIONS IN THE AMOUNT OF $3,613,138.00 AND BY AMENDING THE 2020 INTERGOVERMENTAL GRANT FUND BUDGET BY ADDING TO ANTICIPATIONS AND APPROPRIATIONS IN THE AMOUNT OF $22,795,464.00 FOR HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA); FOR THE PURPOSE OF FUNDING VARIOUS PROJECTS THAT ARE ASSIGNED TO THE DEPARTMENT OF GRANTS AND COMMUNITY DEVELOPMENT, ATLANTA POLICE DEPARTMENT, DEPARTMENT OF PARKS AND RECREATION, DEPARTMENT OF FINANCE, MUNICIPAL COURTS AND DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT AND INCLUDED IN THE 2020 ANNUAL ACTION PLAN OF THE 2020-2024 CONSOLIDATED PLAN; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (the “City”) is required to submit to the U.S. Department of Housing and Urban Development Atlanta’s 2020-2024 Consolidated Plan and 2020 Annual Action Plan for receipt of the 2020 four (4) entitlement grants; and

 

WHEREAS,  the 2020 Annual Action Plan includes project allocations for the following entitlement grants: 1) the Community Development Block Grant (“CDBG”); 2) the Emergency Solutions Grant (“ESG”); 3) the HOME Investment Partnership Program Grant (“HOME”); and 4) the Housing Opportunities for Person with AIDS Grant (“HOPWA”), (collectively, the “Entitlement Grants”); and

 

WHEREAS, the City of Atlanta (City) has received notification of funds from HUD and must anticipate and appropriate funding of $7,156,340 in the 2020 CDBG (Community Development Fund) Budget, $627,336 in the 2020 ESG (Community Development Fund-ESG) Budget, and funding of $2,113,138 in the 2020 HOME (HOME Investment Trust Fund) Budget and $1,500,000 of Home Program Income (HOME Investment Trust Fund) Budget and funding of $22,795,464 in the 2020 Intergovernmental Grant Fund

 

WHEREAS, the City received notification from HUD dated February 19, 2020 which sets forth the Fiscal Year 2020 allocation of Entitlement Grants funding to the City (“HUD Notification” attached hereto as Exhibit A); and

 

WHEREAS, the Department of Grants and Community Development recommend that the 2020 Entitlement Grants awards be distributed amongst the Department of Grants and Community, Atlanta Police Department, Department of Parks and Recreation, Department of Finance, Municipal Courts and the  Department of Planning and Community Development in the amounts set forth (“Grant Amount”) in the Attachments 1-4 and;

 

WHEREAS, the necessary environmental clearances have been obtained from the U.S. Department of Housing and Urban Development; and

 

WHEREAS, HUD authorizes the City of Atlanta pre-award costs based on its program year of January 1, 2020-December 31, 2020. Costs incurred prior to the effective date of the Federal award directly pursuant to the negotiation and in anticipation of the Federal award where such costs are necessary for efficient and timely performance of the scope of work. Such costs are allowable only to the extent that they would have been allowable if incurred after the date of the Federal award and only with the written approval (CPD Notice) of the Federal awarding agency.

 

THE CITY COUNCIL OF THE  CITY  OF  ATLANTA, GEORGIA,  HEREBY ORDAINS as follows:

 

Section 1: That the 2020 Community Development Fund Budget, the 2020 Intergovernmental Budget, and the 2020 HOME Investment Fund Budget are as shown on Attachments 1-4.

 

Section 2: That all ordinances and parts of ordinances in conflict with this ordinance are hereby waived to the extent of the conflict.
