****AN ORDINANCE BY COUNCILMEMBER NATALYN M. ARCHIBONG AUTHORIZING THE MAYOR OR HER DESIGNEE TO PERMANENTLY CLOSE THE PORTION OF GEORGE STREET, S.E. BETWEEN MARTIN LUTHER KING, JR. DRIVE, S.E. AND MEMORIAL DRIVE, S.E.; TO TRANSFER THE PERMANENTLY CLOSED PORTION OF GEORGE STREET, S.E., ATLANTA, GEORGIA FROM THE PURVIEW OF THE DEPARTMENT OF PUBLIC WORKS TO THE PURVIEW OF THE DEPARTMENT OF PARKS AND RECREATION IN CONNECTION WITH THE MEMORIAL DRIVE GREENWAY PROJECT; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”) owns numerous parks, pathways, and other improvements throughout Atlanta and has the goal of providing outdoor spaces for the use of its citizens and visitors as a safe venue to engage in outdoor activities; and

 

WHEREAS, the City has determined that it is in the best interest of the public to facilitate construction associated with the Memorial Drive Greenway Project (“Project”); and

 

WHEREAS, this Project envisions a continuous park experience with lots of trees, seating, shade, water and paths; prioritizes pedestrians on streets near Historic Oakland Cemetery to create space for festival tents and markets; creates a variety of destinations in the park, including an arboretum, a day chapel, fountains, paths, cafes, gardens, and small restaurants; envisions a full cap over the I-85/75 Connector to create a large park space connecting the Capitol building to the rest of the park; and connects over Hill Street using an ADA-accessible pedestrian bridge to increase safety and offer views of downtown; and

 

WHEREAS, the Department of Public Works has purview over the portion of George Street, S.E. between Martin Luther King Jr. Drive, S.E. and Memorial Drive, S.E. (“Property”); and

 

WHEREAS, the Department of Parks and Recreation wishes to enter upon the Property for the purpose of constructing the Project thereon; and

 

WHEREAS, Section 1-102(c)(11) of the Charter grants the City the authority to lay out, open, extend, widen, narrow, establish or change the grade of, vacate, abandon, or close, construct, pave, repave, curb, gutter, adorn with shade trees, otherwise improve, maintain, repair, clean, prevent erosion of, and light streets, alleys, sidewalks, and walkways within the corporate limits of the city; to acquire land for such improvements and to asses the cost or a portion of the cost of payment and enforcement thereof against abutting property under such rules, procedures, terms and conditions as provided by ordinance.

 

WHEREAS, in order to facilitate the construction of the Project, the Commissioner of the Department of Public Works recommends closing the portion of George Street, S.E. between Martin Luther King Jr. Drive, S.E. and Memorial Drive, S.E.; and

 

WHEREAS, the Department of Public Works has agreed that the purview and maintenance of the Property shall be transferred to the Department of Parks and Recreation.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, to be read as follows:

 

SECTION 1:  That the Mayor, or her designee, is authorized to close the portion of George Street, S.E. between Martin Luther King Jr. Drive, S.E. and Memorial Drive, S.E. in order to facilitate the construction of the Memorial Park Greenway Project.

 

SECTION 2: That the Mayor, or her designee, is authorized to transfer purview, management, and maintenance of the Property from the Department of Public Works to the Department of Parks and Recreation.

 

SECTION 3:  That the Mayor, or her designee, is hereby authorized to execute all documents as may be necessary to effectuate the purposes of this Ordinance.

 

SECTION 4:  That all ordinances and parts of ordinances in conflict herewith are hereby repealed for purposes of this ordinance only and only to the extent of the conflict.
