AN ORDINANCE BY COUNCILMEMBER ANDREA L. BOONE AS AMENDED BY THE ATLANTA CITY COUNCIL WAIVING THE PROVISIONS OF SECTION 2-910 OF THE ATLANTA CODE OF ORDINANCES REQUIRING PRIOR AUTHORIZATION OF GRANT APPLICATIONS; AUTHORIZING THE MAYOR'S OFFICE OF HUMAN SERVICES TO APPLY FOR AND ACCEPT A REIMBURSEMENT GRANT AWARD FROM THE STATE OF GEORGIA'S BRIGHT FROM THE START: DEPARTMENT OF EARLY CARE AND LEARNING (DECAL) FOR THE 2019 SUMMER FOOD SERVICE PROGRAM UP TO THE AMOUNT OF NINE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($900,000.00); AND AMENDING THE FY2019 BUDGET TO REFLECT GRANT FUNDS ANTICIPATED AND APPROPRIATED; AND AUTHORIZING THE MAYOR OR HER DESIGNEE ON BEHALF OF THE CITY OF ATLANTA TO ENTER INTO ANY NECESSARY AGREEMENTS IN CONJUNCTION WITH THE SUMMER FOOD SERVICE PROGRAM; AND FOR OTHER PURPOSES.

WHEREAS, the United States Department of Agriculture's Summer Food Service Program was designed to provide children in low-income neighborhoods with nutritious meals during the summer months when children no longer receive school breakfasts or lunches; and

 

WHEREAS, the Summer Food Service Program operates as a program of the Mayor's Office of Human Services, and the coordinator of the Summer Food Service Program operates as an agent of the Mayor; and

 

WHEREAS, the City of Atlanta (the "City") has operated the Summer Food Service Program since 1975; and

 

WHEREAS, each year, the Summer Food Service Program provides free meals to children participating in the summer programs that are sponsored by qualifying non-profit and for-profit organizations; and

 

WHEREAS, sponsors of the Summer Food Service Program receive training to operate the program prior to the program's commencement, and the State of Georgia's Bright from the Start: Department of Early Care and Learning (DECAL) administers such training; and

 

WHEREAS, on February 8, 2019 the coordinator of the Summer Food Service Program attended the State of Georgia's Bright from the Start: Department of Early Care and Learning (DECAL) annual sponsor training for the 2019 Summer Food Service Program; and

 

WHEREAS, the 2019 Summer Food Service Program is expected to provide approximately 106,000 breakfast meals and 117,000 lunches to children in low income communities at approximately sixty (60) sites in Metropolitan Atlanta from June 3, 2019 through August 2, 2019; and

 

WHEREAS, the Mayor's Office of Human Services applied for and was awarded a reimbursement grant award from the State of Georgia's Bright from the Start: Department of Early Care and Learning (DECAL), for the 2019 Summer Food Service Program; and

 

WHEREAS, prior legislative authorization was not obtained for the grant application, as required by Section 2-910 of the Atlanta City Code; and

 

WHEREAS, reimbursements from Bright from the Start are based on the number of meals served.

 

WHEREAS, an agreement entered with Acsential Technologies, Inc. to provide breakfast and lunch including a minimum of two hot meals each week for the Summer Food Service Program.

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS, as follows:

 

 

 

SECTION 1: That the Mayor is hereby authorized to apply for and accept a reimbursement grant from the State of Georgia's Bright from the Start: Department of Early Care and Learning (DECAL), for the 2019 Summer Food Service Program, and the Mayor's Office of Human Services is authorized to proceed with preliminary steps such as hiring and training employees, approving sites, securing food and transportation, and proceeding with other steps necessary for the commencement of the 2019 Summer Food Service Program to ensure an uninterrupted program for the period June 3, 2019 through August 2, 2019.

 

Section 2: That the provision of Section 2-910 of the Code of Ordinances requiring prior legislative authorization of grant applications is hereby waived for purpose of this ordinance only.

 

Section 3: That the FY2019 Budget shall be amended in an amount up to Nine Hundred Thousand Dollars and no cents ($850,000.00) as follows:

SECTION 4:   That the Mayor is authorized to execute all appropriate documents required to accept the above­ referenced Grant. Said documents shall not become binding upon the City until they have been executed by the Mayor or her designee and delivered to Department of Early Care and Learning.

 

SECTION 5: That all ordinances or parts of ordinances in conflict herewith are hereby waived to the extent of the conflict.
