AN ORDINANCE BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE CHIEF FINANCIAL OFFICER TO WRITE-OFF WATER AND WASTEWATER ACCOUNTS RECEIVABLE FOR SUCH ACCOUNTS RENDERED UNCOLLECTIBLE, IN AN AMOUNT NOT TO EXCEED NINE MILLION, TWO HUNDRED THOUSAND, SEVEN HUNDRED FORTY-THREE DOLLARS AND SEVEN CENTS ($9,200,743.07), ON BEHALF OF THE DEPARTMENT OF WATERSHED MANAGEMENT; AND FOR OTHER PURPOSES.

WHEREAS, pursuant to Ordinance No. 90-O-1324, the Chief Financial Officer has the authority to administratively write-off or otherwise discharge any account receivable in any amount not exceeding Ten Thousand Dollars and Zero Cents ($10,000.00), which is held by the City of Atlanta (“City”) against any person, organization, or entity, either public or private, however created or arising, be it by contract, open account, judgment, fi fa, lien or otherwise, which is determined by the Chief Financial Officer and the City Attorney to be legally uncollectible;

WHEREAS, the City’s auditors apply generally accepted accounting principles stating that such accounts receivable should be written off to accurately reflect the value of accounts receivable assets in the City’s financial statements;

WHEREAS, the City’s auditors have recommended that the City review its aged accounts receivable on the general ledger and perform annual write-offs of accounts deemed uncollectible, according to generally accepted accounting principles;

WHEREAS, the Department of Watershed Management has determined that there are two hundred eighty-four (284) accounts with balances in excess of Ten Thousand Dollars and Zero Cents ($10,000.00) each and are uncollectible, which total Nine Million, Two Hundred Thousand, Seven Hundred Forty-Three Dollars and Seven Cents ($9,200,743.07); and

WHEREAS, the Chief Financial Officer and the City Attorney recommend that the two hundred eighty-four (284) outstanding water and wastewater accounts should be written off as uncollectible per generally accepted accounting principles.  

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA ORDAINS as follows:

SECTION 1:  That the Chief Financial Officer is authorized to write-off two hundred eighty-four (284) outstanding water and wastewater accounts with balances in excess of Ten Thousand Dollars and Zero Cents ($10,000.00), in an amount not to exceed Nine Million, Two Hundred Thousand, Seven Hundred Forty-Three Dollars and Seven Cents ($9,200,743.07) herein attached as Exhibit A.

SECTION 2:  The City does not waive and expressly reserves its right to otherwise collect and assert available rights and remedies to collect the fees contemplated by this Ordinance and subject to write offs, specifically including, without limitation, the City’s lien rights.

SECTION 3: That all ordinances and parts of Ordinances in conflict herewith be waived to the extent of the conflict.
