Body

WHEREAS, pursuant to Ordinance 17-0-1787, Chapter 10 (Alcohol Code) of the Code of Ordinances was amended to allow microbreweries in commercial and mixed-use zoning districts; and

 

WHEREAS, pursuant to Ordinance 16-0-1174, the City rezoned certain properties depicted on Exhibit "A" and listed on Exhibit "B" to said ordinance from MRC-3-C to MRC-3-C for the purpose of change of zoning conditions; and

 

WHEREAS, Exhibit "C" to said ordinance contains zoning conditions setting forth, among other things, the permitted uses on said properties, notwithstanding anything to the contrary set forth in the MRC district regulations, and which does not include microbreweries; and

 

WHEREAS, amendment to the list of permitted uses to add microbreweries to the list of permitted uses is in the public health, safety and welfare.

 

THE   CITY  COUNCIL OF  THE  CITY  OF  ATLANTA, GEORGIA  HEREBY ORDAINS, as follows:

 

Section 1. The Zoning Ordinance of the City of Atlanta is hereby amended, and the official zoning maps established  in connection  therewith are changed  so that the following properties are rezoned from the MRC-3-C (Mixed Residential Commercial-3 conditional) zoning district to the MRC-3-C (Mixed Residential Commercial-3-conditional) zoning district for the purpose of change of condition, said properties being more particularly depicted and described as, to wit:

 

ALL THOSE TRACTS or parcels of land lying in Land Lots 53, 54 & 75 of the 14th District, Fulton County, Georgia being more particularly depicted in Exhibit "A" and listed on Exhibit "B", attached hereto and incorporated herein by reference.

 

Section 2. This amendment is approved under the provisions of Section 16-02.003  of the City of Atlanta Zoning Ordinance entitled "Conditional Development" as identified with the use of the suffix "C" after the district designation.  The Director of the Office of Buildings shall issue building permits for the development of the properties with said "Conditional Development" zoning district designation only in compliance with the conditions set forth in

16-0-1174/Z-16-31 and this ordinance.

 

 

Section 3. Condition # 2 to Exhibit "C" of Ordinance 16-0-1174, setting forth the list of permitted principal uses, is amended include "microbrewery", as that term in defined by Section 10-1 of the Atlanta Code of Ordinances, to the list of permitted principal uses on the properties described in section 1 above.

 

Section 4.  That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
