WHEREAS. the Cabbagetown Historic District was established to preserve the environmental and physical appearance of the area, including industrial, commercial and residential structures, created from the late 19th century to the mid-20th century; and

 

WHEREAS, regulations were established to ensure that ensuing development is compatible with existing historic  architectural and spatial  characteristics to help; preserve  the unique historical relationship between commercial and residential uses in this historic area; and

 

WHEREAS, the City Council finds that prohibiting certain uses in the Cabbagetown Historic District will help to preserve the historic integrity of the area and preserve and maintain significant historic elements of the Village; and

 

WHEREAS, the City Council finds this rezoning will serve the public health, safety, and general welfare of the community.

 

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS:

 

Section 1: that, City Code Section 16-20a.Oll Transitional Commercial (Subarea 5) 1. (d) (4); Which now reads:

 

(1)  Permitted principal uses and structures. A building or premises shall be used only for the following principal purposes.

d)

 

4. Professional or service establishments.

Drive-thru and drive-in services, windows, and facilities are prohibited. Hiring halls are prohibited. Blood donor stations are prohibited. No wholesaling or jobbing shall be conducted from within the Cabbagetown Landmark District. No use or manner of operation shall be permitted that is obnoxious or offensive by reason of odor, smoke, noise, glare, fumes, gas, vibration, unusual danger of fire or explosion, emission of particulate matter, interference with radio, television, or wireless data reception, or for other reasons incompatible with the character of this subarea and its relationship to adjoining residential subareas

 

Is hereby amended to read:

(1) Permitted principal uses and structures.  A building or premises shall be used only for the following principal purposes

4. Professional or service establishments.

Drive-thru and drive-in services, windows, and facilities are prohibited. Hiring halls are prohibited. Service stations are prohibited.  Secured-storage facilities are prohibited. Car washes are prohibited. Funeral Homes are prohibited. Bod y shops and Sales lots for automobiles are prohibited.  Blood donor stations are prohibited.  No wholesaling or jobbing shall be conducted from within the Cabbagetown Landmark District.  No use or manner of operation shall be permitted that is obnoxious or offensive by reason of odor, smoke, noise, glare, fumes, gas, vibration, unusual danger of fire or explosion, emission of particulate matter. interference with radio, television, or wireless data reception, or for other reasons incompatible with the character of this subarea and its relationship to adjoining residential subareas

 

Section 2: That All Ordinances, Parts of Ordinances, And resolutions in conflict herewith are here by waived for purposes of this Ordinance only, and only to the extent of said conflict.
