A RESOLUTION BY COUNCILMEMBERS MATT WESTMORELAND, JENNIFER N. IDE, AMIR R. FAROKHI, J. P. MATZIGKEIT, DUSTIN HILLIS, AND ANDRE DICKENS CALLING FOR THE CLOSURE OF THE ATLANTA CITY DETENTION CENTER, A TRANSPARENT, COMMUNITY-FOCUSED CONVERSATION TO ENSURE THE CONTINUED SAFETY OF THE CITY, DETERMINE THE REPURPOSING OF THE FACILITY AND THE REALLOCATION OF FUNDS, AND A COMPASSIONATE, EMPLOYEE-CENTERED PROCESS TO ENSURE A FAIR TRANSITION FOR ALL AFFECTED EMPLOYEES; AND FOR OTHER PURPOSES.

WHEREAS, since the 1950s, the City of Atlanta has operated a detention center and in 1995, opened the $56 million, 1300-bed Atlanta City Detention Center (“ACDC”); and

 

WHEREAS, the ACDC is operated by the Department of Corrections and in Fiscal Year 2018, operating costs reached $33 million with 360 employees; and

 

WHEREAS, the ACDC has never reached capacity, but the City has leased extra bed space to other law enforcement agencies to house detainees awaiting court appearances in other jurisdictions; and

 

WHEREAS, over the past several years, the nightly inmate-population has steadily decreased, with most of the detainees being housed under voluntary detainment contracts with the federal and state governments; and

 

WHEREAS, a June 2018, an Executive Order suspending the acceptance of additional detainees from U.S. Customs and Immigration Enforcement has led to a further decline in the nightly inmate-population; and

 

WHEREAS, the City of Atlanta has taken important steps toward public safety and community wellness over the last four years; and

 

WHEREAS, the reforms of Pre-Arrest Diversion, Marijuana Decriminalization and Bail Reform evidence an increasing understanding that jailing people for behavior stemming from extreme poverty, addiction, or mental health challenges has been ineffective at improving public safety and has had negative impacts on individuals, families, and the City as a whole; and

 

WHEREAS, the City should strive toward an Atlanta where policy initiatives are aligned with what we believe in as a City; that stable and healthy families and communities are the lynchpin to community safety and wellness; and

 

WHEREAS, closing the Atlanta City Detention Center, repurposing the facility to benefit the community, and reinvesting operating funds into existing and new initiatives, services and programs that enhance the quality of life for all residents will make Atlanta a stronger city; and

 

WHEREAS, the planning and implementation of the Atlanta City Detention Center closure, should be done carefully and thoughtfully to minimize any negative impact to the City, Department of Corrections employees and any others who will be affected by the closure.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the City shall begin the process to close the Atlanta City Detention Center, conduct a transparent, community-focused conversation to ensure the continued safety of the City, determine the how the facility should be repurposed, how the resultant cost savings should be reinvested, and develop an employee-centered process to ensure a positive transition for all affected employees.

 

BE IT FURTHER RESOLVED, the facility will transition completely from use as a jail, detention center or corrections facility, to one that provides a positive, meaningful service to residents of Atlanta and the surrounding community.

 

BE IT FURTHER RESOLVED, the City shall convene an advisory committee made up of city residents, social service providers, community organizations, the academic community, the business community, the faith community, public safety representatives, and elected officials, for a public conversation about the repurposing of the facility before any final decision is made.

 

BE IT FURTHER RESOLVED, the resulting cost savings from the closure should be reinvested in several areas of need throughout the City including, but not limited to; public safety, workforce development, code enforcement and neighborhood revitalization, early childhood education, infrastructure improvements, additional public defenders, and other worthy investments.

 

BE IT FURTHER RESOLVED, the City shall develop a comprehensive plan and working team to support each impacted employee as they seek retirement, new employment within City government or transition externally.

 

BE IT FURTHER RESOLVED, the City shall enact a public awareness communication plan to inform residents of the implications of closing the Atlanta City Detention Center, including but not limited to; understanding the difference between the Atlanta City Detention Center and the Fulton County Jail, which houses (and will continue to house) those accused of misdemeanor and felony crimes.

 

BE IT FINALLY RESOLVED, to ensure the closure of the Atlanta City Detention Center will not  have negative impacts on other judicial agencies and that all policies and regulations are in line with these reforms, the City shall review ordinances which currently remand detainees to the Atlanta City Detention Center, as well as review current Atlanta Police Department Standard Operating Procedures to consider issuing citations or a copy of charges in lieu of arrests for city and state traffic violations.
