AN ORDINANCE TO AMEND CHAPTER 32A OF THE ZONING CODE OF THE CITY OF ATIANTA, ENTITLED "LITTLE FIVE POINTS NEIGHBORHOOD COMMERCIAL DISTRICT REGULATIONS" SO AS TO ALLOW AN INCREASE IN THE PERMITTED SIZE OF COMMERCIAL RECREATION ESTABLISHMENTS SO THAT LARGER THEATRES AND SIMILAR PLACES OF ASSEMBLY CAN BE LOCATED IN THE DISTRICT; AND FOR OTHER PURPOSES.

WHEREAS, the general regulations for Neighborhood Commercial Districts set a cap of the size of commercial recreation establishments at 8,000 square feet; and

 

WHEREAS, theaters located in places of assembly in the Little Five Points Neighborhood prior to the enactment of the Little Five Points Neighborhood Commercial District regulations could be more than 8,000 square feet; and

 

WHEREAS, after the enactment of the Little Five Points Neighborhood Commercial District regulations no theater would be permitted to relocate to or build a space larger than 8,000 square feet; and

 

WHEREAS, local theaters contribute to the cultural identity of the Little Five Points Neighborhood Commercial District and enrich the lives of residents and visitors; and

 

WHEREAS, in order to accommodate the growth of local theaters, it is in the best interest of the public that the general regulations for Neighborhood Commercial Districts which set a cap of 8,000 square feet on the size of commercial recreation establishments, which includes theatres and similar places of assembly, be amended for the Little Five Points Neighborhood Commercial District to allow for such uses;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ATIANTA, GEORGIA, as follows:

 

Section 1. The Code of Ordinance of the City of Atlanta is amended at Chapter 32A entitled Little Five Points Neighborhood Commercial District Regulations by adding a new subsection 6 to Section 16-32A.002 which is to read as follows:

6. Commercial recreation establishments, including theaters and other places of assembly and similar uses with primary activities conducted within fully enclosed buildings may exceed 8,000 square feet; provided however that no such use shall exceed 20,000 square feet.

 

Section 2: This ordinance shall become effective when signed by the Mayor or as otherwise provided by operation of law.
