A RESOLUTION BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR OR HIS DESIGNEE TO EXERCISE RENEWAL TERM OPTION NUMBER TWO (2) OF COOPERATIVE PURCHASING AGREEMENT NUMBER FC-7694 WITH CA, INC., PURSUANT TO SECTION 2-1602 OF THE CITY OF ATLANTA CODE OF ORDINANCES, UTILIZING FEDERAL GENERAL SERVICES ADMINISTRATION CONTRACT NUMBER GS-35F-0823M FOR THE PURCHASE OF CA SOFTWARE LICENSES AND SUPPORT FOR THE CITY’S HOSTED MAINFRAME APPLICATIONS, ON BEHALF OF THE DEPARTMENT OF ATLANTA INFORMATION MANAGEMENT, IN AN AMOUNT NOT TO EXCEED NINETY-FIVE THOUSAND FOUR HUNDRED TWELVE DOLLARS AND SIXTY CENTS ($95,412.60) FOR A TERM OF ONE (1) YEAR, EFFECTIVE SEPTEMBER 1, 2016 TO AUGUST 31, 2017 WITH ONE (1) REMAINING ONE-YEAR RENEWAL TERM OPTION, SUBJECT TO FISCAL YEAR 2017 BUDGET APPROVAL; ALL CONTRACTED WORK TO BE CHARGED TO AND PAID FROM THE FUNDING NUMBERS LISTED HEREIN, AND FOR OTHER PURPOSES.

Body

WHEREAS, CA Technologies Inc. (“CA”), provides the City of Atlanta (“City”) with Mainframe Operations Management, Desktop Management, Network Management licenses and support; and

 

WHEREAS, pursuant to Article X, Division 15 Intergovernmental Relations of the City of Atlanta Code of Ordinances (the “Code”), the Chief Procurement Officer may procure supplies, services or construction items through contracts established by a public procurement unit outside the City; and

 

WHEREAS, the Chief Procurement Officer has evaluated and determined that competitive procedures akin to those used by the City were used by the General Services Administration of the United States Federal Government (“Federal GSA”) in the development of the contract from which the cooperative purchasing agreement was derived and that the cost of the goods, supplies, services or construction are comparable to or less than the cost of the same goods, supplies, services or construction if obtained through city procurements under Division 4 of the City Procurement Code; and

 

 

WHEREAS, Resolution 14-R-4000, adopted by the Atlanta City Council (“Council”) on September 2, 2014 and approved on September 11, 2014 authorized the Mayor or his designee to enter into Cooperative Purchasing Agreement Number FC-7694 (“Agreement Number FC-7694”) with CA, Inc. for the support of the City’s hosted mainframe applications (Mainframe Operations Management, Desktop Management, Network Management licenses and support) for nine (9) months, with three (3) remaining one-year renewal term options, in an amount not to exceed One Hundred Seven Thousand Four Hundred Ninety-Six Dollars and Thirty-Four Cents ($107,496.34); and

 

WHEREAS, pursuant to Resolution 15-R-3815 (adopted by Council on July 20, 2015 and approved, as per City Charter Section 2-403 on July 29, 2015), the City entered into Renewal Term Option Number One (1) with CA, Inc., Agreement Number FC-7694, utilizing Federal GSA Contract Number GS-35F-0823M as a source for the cooperative purchase of CA software licenses and support for the City’s hosted mainframe applications (Mainframe Operations Management, Desktop Management, Network Management licenses and support), in an amount not to exceed Ninety-Five Thousand Four Hundred Twelve Dollars And Sixty Cents ($95,412.60), for a term of one (1) year effective September 1, 2015 to August 31, 2016 with two (2) remaining one-year renewal term options; and

 

WHEREAS, Federal GSA Contract Number GS-35F-0823M remains in effect; and

 

WHEREAS, the Chief Information Officer and the Chief Procurement Officer now recommend exercising Renewal Term Option Number Two (2) with CA, Inc., Agreement Number FC-7694, utilizing Federal GSA Contract Number GS-35F-0823M as a source for the cooperative purchase of CA software licenses and support for the City’s hosted mainframe applications (Mainframe Operations Management, Desktop Management, Network Management licenses and support), in an amount not to exceed Ninety-Five Thousand Four Hundred Twelve Dollars and Sixty Cents ($95,412.60), for a term of one (1) year effective September 1, 2016 to August 31, 2017 with one (1) remaining one-year renewal term option; all contracted work to be charged to and paid from the Fund, Department Organization, Account, and Function Activity (“FDOA”) numbers listed below.

 

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Mayor or his designee is authorized to exercise Renewal Term Option Number Two (2) of Agreement Number FC-7694 with CA, Inc. utilizing Federal GSA Contract Number GS-35F-0823M for CA software licenses and support for the City’s hosted mainframe applications (Mainframe Operations Management, Desktop Management, Network Management licenses and support) in an amount not to exceed Ninety-Five Thousand Four Hundred Twelve Dollars and Sixty Cents ($95,412.60), subject to Fiscal Year 2017 Budget approval for a term of one (1) year effective September 1, 2016 to August 31, 2017 with one (1) remaining one-year renewal term option.

 

BE IT FURTHER RESOLVED, that the funding of the Agreement shall be subject to and expressly contingent upon the City’s adoption and approval of the FY 2017 budget and the appropriation of sufficient funds to the associated funding sources.

 

BE IT FURTHER RESOLVED, that all contracted work will be charged to and paid from the following FDOA numbers: 1001 (General Fund) 050202 (DIT IT Applications) 5213001 (Consulting/Professional Services-Technical) 1535000 (Data Processing/ Management Information Systems). 

 

BE IT FURTHER RESOLVED, that the Chief Procurement Officer or his designee, in consultation with the City Attorney, be hereby directed to prepare an appropriate agreement for execution by the Mayor or his designee.

 

BE IT FINALLY RESOLVED, that the agreement will not become binding on the City, and the City will incur no obligation or liability under it, until it has been approved as to form by the City Attorney or her designee, executed by the Mayor or his designee, attested to by the Municipal Clerk or her designee, and delivered to CA, Inc.
