A RESOLUTION BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR OR HIS DESIGNEE TO EXERCISE RENEWAL TERM OPTION ONE (1) OF PURCHASING AGREEMENT NUMBER FC-8207 WITH GARTNER INCORPORATED, UTILIZING MASTER CLIENT AGREEMENT NUMBER 9800-SS001 BETWEEN GEORGIA TECHNOLOGY AUTHORITY AND GARTNER INCORPORATED, PURSUANT TO SECTION 2-1602 ET SEQ. OF THE CITY OF ATLANTA CODE OF ORDINANCES, TO PURCHASE SUBSCRIPTION-BASED TECHNOLOGY RESEARCH AND ADVISORY SERVICES, ON BEHALF OF THE DEPARTMENT OF ATLANTA INFORMATION MANAGEMENT FOR ONE (1) YEAR, EFFECTIVE JULY 1, 2016 TO JUNE 30 2017, WITH TWO (2) REMAINING ONE-YEAR RENEWAL TERM OPTIONS, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED TWENTY-EIGHT THOUSAND DOLLARS AND ZERO CENTS ($228,000.00); ALL CONTRACTED WORK TO BE CHARGED TO AND PAID FROM FUNDING NUMBERS LISTED HEREIN, SUBJECT TO AND EXPRESSLY CONTINGENT UPON THE ADOPTION AND APPROVAL OF THE FISCAL YEAR 2017 BUDGET; AND FOR OTHER PURPOSES.

Body

WHEREAS, Gartner Incorporated (“Gartner”)  provides  research and advisory services designed to assist the Department of Atlanta Information Management (“AIM”) in the long-term assessment, planning, and implementation of   technology goals and objectives; and

 

WHEREAS, AIM has an ongoing need for Gartner’s technology research and advisory services, which  enable key personnel in AIM to make informed decisions based on current industry research and planning assumptions, and to also develop negotiation strategies based on proven techniques; and

 

WHEREAS, pursuant to Article X, Division 15, Intergovernmental Relations, of the City of Atlanta Code of Ordinances (the “Code”), the Chief Procurement Officer may procure supplies, services or construction items through contracts established by a public procurement unit outside the City; and

 

WHEREAS, pursuant to Resolution 15-R-3362 (adopted by the Atlanta City Council on June 15, 2015 and approved June 24, 2015 as per City Charter Section 2-403), the City entered into Cooperative Purchasing Agreement Number FC-8207 with Gartner, utilizing Master Client Agreement Number 9800-SS001 between Georgia Technology Authority with Gartner to purchase technology research and advisory services for a term of one (1) year, with three (3) one-year renewal term options ,effective July 1, 2015 to June 30, 2016, , in an amount not to exceed Two Hundred Fourteen Thousand Eight Hundred Dollars and no Cents ($214,800.00)

WHEREAS, Master Client Agreement Number 9800-SS001 between Georgia Technology Authority and Gartner is still in effect and remains a viable procurement vehicle for the purchase of subscription-based technology research and advisory services

and

 

WHEREAS, the Chief Procurement Officer has evaluated and determined that procedures akin to those used by the City were used by the GTA in the procurement of the contract from which the cooperative purchasing agreement will be derived and that the cost of the goods, supplies, services or construction are comparable to or less than the cost of the same goods, supplies, services or construction if obtained through city procurements under Division 4 of the City Procurement Code; and

 

WHEREAS, the Chief Information Officer now recommends exercising renewal term option number one (1) of Cooperative Purchasing Agreement FC-8207 with Gartner to purchase technology research and advisory services for a term of one (1) year, with two (2) remaining one-year renewal term options ,effective July 1, 2016 to June 30, 2017, in an amount not to exceed Two Hundred Twenty-Eight Thousand Dollars and no Cents ($228,000.00), subject to and expressly contingent upon the City’s adoption and approval of the Fiscal Year 2017 budget and the appropriation of sufficient funds to the associated funding sources.

 

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Mayor or his designee is authorized to exercise renewal term option number one (1) of Cooperative Purchasing Agreement FC-8207 with Gartner to purchase technology research and advisory services for a term of one (1) year, effective July 1, 2016 to June 30, 2017, with two (2) remaining one-year renewal term options, in an amount not to exceed Two Hundred Twenty-Eight Thousand Dollars and no Cents ($228,000.00),

 

BE IT FURTHER RESOLVED, that all contracted work shall be charged to and paid from the following Fund, Department Organization, Account, and Function Activity (“FDOA”):

BE IT FURTHER RESOLVED, that the funding of the agreement shall be subject to and expressly contingent upon the City’s adoption and approval of the Fiscal Year 2017 budget and the appropriation of sufficient funds to the associated funding sources.

 

BE IT FURTHER RESOLVED, that the Chief Procurement Officer or his designee, in consultation with the City Attorney or her designee, is directed to prepare the appropriate agreement for execution by the Mayor.

 

BE IT FINALLY RESOLVED, that the agreement will not become binding on the City, and the City will incur no obligation or liability under it, until it has been approved as to form by the City Attorney or her designee, executed by the Mayor or his designee, attested to by the Municipal Clerk, and delivered to Gartner, Inc.
