Z-16-24 AN ORDINANCE BY COUNCILMEMBER CARLA SMITH TO AMEND CHAPTER 20K OF THE 1982 ZONING ORDINANCE OF THE CITY OF ATLANTA, AS AMENDED, TO CHANGE THE ALLOWABLE FLOOR AREA RATIO FOR MULTI-FAMILY RESIDENTIAL USES IN THE TRANSITIONAL INDUSTRIAL SUBAREA III; AND FOR OTHER PURPOSES.

Whereasthe Grant Park Historic District was created by 99-O-2042 adopted by the City Council on April 3, 2000 and approved as per the City Charter 2-403 on April 11, 2000; and

      

Whereas, Section 16-20K.009(3) requires that nonindustrial uses developed in the Transitional Industrial Subarea III comply with Section 16-20K.008; and

      

Whereas, Section 16-20K.008(3)(a)(2) provides that multi-family residential developments be limited to a floor area ratio of .696 times net lot area; and

      

 

Whereas, the SPI-22 Memorial Drive/Oakland Cemetery Special Public Interest District also applies to certain properties within the Grant Park Historic District; and

 

Whereas, this conflict in residential development rights is problematic for properties which are contained partially within Subarea 4 (Grant Park North) of SP1-22 and the Transitional Industrial Subarea III of the Grant Park Historic District; and

Whereasthe Transitional Industrial Subarea III regulations should be amended to reduce the discrepancy between the allowable development within both districts.

    

 

NOW, THEREFORE, The City Council of the City of Atlanta, Georgia, hereby ordains:

 

 

SECTION 1:  Section 16-20K.009(3) is hereby amended to read as follows:


Other Uses.  For uses other than industrial uses, the controls and requirements set forth in Section 16-20K.008 shall apply, with the exception of Section 16-20K.008(3)(a)(2). Multi-family residential uses shall be limited in the Transitional Industrial Subarea III to a floor area ratio of 1.2 times net lot area.

 

SECTION 2:  This ordinance shall become effective immediately upon its approval by the City Council and signature by the Mayor or by operation of law.
