A RESOLUTION BY COUNCILMEMBER CARLA SMITH AS SUBSTITUTED BY COMMUNITY DEVELOPMENT/HUMAN SERVICES COMMITTEE AMENDING RESOLUTION 20-R-4066 WHICH WAS ADOPTED BY THE ATLANTA CITY COUNCIL ON AUGUST 3, 2020 AND APPROVED BY MAYOR KEISHA LANCE BOTTOMS ON AUGUST 11, 2020 AND WHICH AUTHORIZED THE MAYOR, ON BEHALF OF THE CITY OF ATLANTA (“CITY”), TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT (“IGA”) WITH THE FULTON COUNTY/CITY OF ATLANTA LAND BANK AUTHORITY (“LBA”) TO ACCEPT TITLE TO CERTAIN PROPERTIES AND TO RE-CONVEY TITLE TO SAID PROPERTIES TO INVEST ATLANTA IN ACCORDANCE WITH THE IGA; AUTHORIZING THE CITY TO DIRECT THAT DEEDS IN LIEU OF FORECLOSURE TO CERTAIN PROPERTIES BE ISSUED TO LBA ON BEHALF OF THE CITY; AUTHORIZING THE MAYOR TO EXECUTE THE NECESSARY QUIT CLAIM DEEDS TO CONVEY CERTAIN PROPERTIES TO THE LBA FOR DEVELOPMENT/REDEVELOPMENT PURPOSES IN ACCORDANCE WITH IGA; AND FOR OTHER PURPOSES.

Body

WHEREAS, since 2012, the City engaged in the processes authorized by Appendix E, Articles III and V and Chapter 74, Article V to address a number of properties (“Abatement Properties”) resulting in liens in favor of the City (“Code Liens”) against each of said Abatement Properties in the amount of the associated Abatement costs; and

 

WHEREAS, on August 3, 2020, the Atlanta City Council passed Resolution 20-R-4066 which authorized the Mayor, or her designee, to enter into an intergovernmental agreement (“IGA”) with the Fulton County/City Of Atlanta Land Bank Authority (“LBA”) to accept title to certain properties subject to City Code enforcement liens (“Abatement Properties”) and to re-convey title to said Properties to Invest Atlanta in accordance with the IGA; and authorizing the City to direct that deeds in lieu of foreclosure to certain Properties be issued to LBA on behalf of the City, all pursuant to a program (the “Program”) established by the City and the aforesaid partners to help increase the supply of affordable housing within the City in accordance with and in furtherance of the One Atlanta Housing Affordability Action Plan (the "One Atlanta Initiative"); and

 

WHEREAS, on August 11, 2020, Mayor Keisha Lance Bottoms approved Resolution 20-R-4066; and

 

WHEREAS, in accordance with Resolution 20-R-4066, the City has further determined that the Abatement Properties should be proactively utilized and deployed in such ways as the City determines in furtherance of the City Plans and Initiatives; and

 

WHEREAS, in accordance with Resolution 20-R-4066, in order for the City to liquidate the Code Liens on the Abatement Properties, and either convert said liens to cash or acquire and make available the Abatement Properties for redevelopment in furtherance of the City Plans and Initiatives, the City must initiate foreclosure proceedings and other enforcement efforts; and

 

WHEREAS, certain owners of Abatement Properties (“Owner Developers”) have offered to develop their Properties as affordable housing that will be made available to qualified buyers under terms and otherwise consistent with and in furtherance of the One Atlanta Initiative, in exchange for the City’s agreement to forego enforcement action on the respective Code Liens; and

 

WHEREAS, the City would like to expand the Program to include the development and provision of additional affordable housing by Owner-Developers under contractual terms and conditions consistent with the [Form of Agreement attached hereto as “Exhibit “A”]; and

 

WHEREAS, such an expansion of the City’s Program would facilitate the construction of affordable housing and increase the overall supply of affordable housing available to qualified Atlanta residents by leveraging existing Code Liens with private funds, consistent with the One Atlanta Initiative;

 

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA that Resolution 20-R-4066 is hereby amended to authorize the Mayor, or her designee, or the Commissioner of the City of Atlanta Department of City Planning, or his/her designee, on behalf of the City, to negotiate and execute any Agreements concerning Abatement Properties that she deems necessary to further the objectives of the One Atlanta Initiative and create or preserve workforce affordable housing units including, without limitation, agreements with Developer Owners of Abatement Properties requiring the construction of workforce affordable housing made available to qualifying individuals and families in exchange for lien cancellations.

 

BE IT FURTHER RESOLVED, that Resolution 20-R-4066 is hereby further amended to authorize the Commissioner of the City of Atlanta Department of City Planning, or his/her designee, to develop and implement criteria for approving or denying agreements with owner-developers.  These agreements shall be in substantially the same form as attached hereto as Exhibit “A”.

 

BE IT FURTHER RESOLVED, that Resolution 20-R-4066 is hereby further amended to authorize the Commissioner of the City of Atlanta Department of City Planning, or his/her designee, to execute any related agreements or documents required, appropriate or helpful, including Land Use Restrictive Agreements, to document and help ensure the establishment and continuing affordability of workforce housing and affordable housing constructed under this Program.

 

BE IT FURTHER FINALLY RESOLVED, that all resolutions in conflict with this resolution are repealed to the extent of the conflict.
