A RESOLUTION TO EXTEND INTERIM CONTROLS ON THE PENDING DESIGNATION OF THE “306 PONCE DE LEON - ATLANTA EAGLE LANDMARK BUILDING / SITE (LBS)”; AND FOR OTHER PURPOSES.

 

WHEREAS, on December 14, 2020, the Executive Director of the Atlanta Urban Design Commission (UDC), pursuant to City Code Sec. 16-20.005(b), mailed written notice to the property owner of his intent to nominate their property as the 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS) (the “Notice of Intent to Nominate”); and

 

WHEREAS, pursuant to City Code Sec. 16-20.005(c), the legal effect of said notice of intent to nominate is to impose upon such properties the full legislative protection of, and be controlled by, the regulations governing historic districts set forth in chapter 20 of the Atlanta Zoning Ordinance; and

 

WHEREAS, the proposed 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS) is significant to the City of Atlanta as set forth in the Nomination Resolution (N-20-407 / D-20-407) and its attachments and meets the minimum and specific criteria for a Landmark Building / Site (LBS) found in City Code Sec. 16-20.004 as set forth in the same Nomination Resolution and its attachments; and

 

WHEREAS, the proposed 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS) boundary is as described in the general plat map and general boundary description set forth in the Notice of Intent to Nominate; and

 

WHEREAS, the UDC held a public hearing on January 13, 2021 which was continued to January 27, 2021 and formally nominated this property for protection as a Landmark Building / Site (LBS) as set forth in the Nomination Resolution of the Atlanta Urban Design Commission (N-20-407 / D-20-407); and

 

WHEREAS, this nomination and pending designation of the proposed 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS) recognizes and allows the City to protect its historic, cultural and architectural significance of the buildings in the area; and

 

WHEREAS, pursuant to City Code Sec. 16-20.005(c)(2), the 120-day interim control period is set to expire on April 13, 2021; and

 

WHEREAS, pursuant to City Code Sec. 16-20.005(c)(2), the 120-day interim control period may be extended by resolution of council only if said extension is due to delay in the legislative process and only for a period of time equal so any such delay, but in no event shall the total interim control period exceed a maximum of 180 days; and

 

WHEREAS, the City Council finds that an extension of the interim control period for not more than 60 days is warranted due to delays in the legislative process and to potentially develop an appropriate regulatory framework for the proposed 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS) which would consider the City’s historic preservation goals, the intent of the City’s Historic Preservation Ordinance, and the property owner’s goals; and

 

WHEREAS, it is in the best interest of the health, safety and welfare of the citizens of the City of Atlanta that these interim controls be extended to allow this Landmark Building / Site (LBS) legislation to be considered and voted upon by the City Council.

 

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that:

 

Section 1:              Pursuant to City Code Sec. 16-20.005(c)(2), interim controls for the proposed 306 Ponce de Leon Ave-Atlanta Eagle Landmark Building / Site (LBS), as described in the general plat map and general boundary description set forth in the Notice of Intent to Nominate, is hereby extended from April 13, 2021 through and including June 30, 2021.  In the event the City Council adopts the rezoning legislation, and the designation becomes law prior to June 30, 2021, the interim control period shall expire as of such earlier date.  In the event the City Council files the rezoning legislation, and the designation does not become law, the interim control period shall expire as of the date of the filing of the legislation. 

 

Section 2:              This resolution shall become law upon the date of approval of this ordinance by the Mayor or by operation of the City Charter.
