AN ORDINANCE BY COMMUNITY DEVELOPMENT/HUMAN SERVICES COMMITTEE TO WAIVE THE SOURCE SELECTION AND PAYMENT PROVISIONS CONTAINED IN THE CITY OF ATLANTA CODE OF ORDINANCES, ARTICLE X, PROCUREMENT AND REAL ESTATE CODE AND TO AUTHORIZE THE MAYOR, ON BEHALF OF THE CITY OF ATLANTA, TO ENTER INTO AMENDMENT NUMBER FOUR (4) OF FC-4944, SPECIAL PROCUREMENT FOR MANAGEMENT AND OPERATION OF VARIOUS TENNIS CENTERS WITH UNIVERSAL TENNIS MANAGEMENT, LLC TO EXTEND THE TERM OF THE AGREEMENT ON A MONTH-TO-MONTH BASIS FOR A PERIOD NOT TO EXCEED SIX (6) MONTHS AND TO BECOME EFFECTIVE FEBRUARY 11, 2020; AND FOR OTHER PURPOSES.

Body

WHEREAS, the City of Atlanta (“City”)  provides recreational tennis programs and owns  several tennis centers throughout the City, to wit: Sharon E. Lester Tennis Center in Piedmont Park, Washington Park Tennis Center in Washington Park, Chastain Park Tennis Center in Chastain Park, Bitsy Grant Tennis Center in Atlanta Memorial Park and McGhee Tennis in John A. White Park (collectively the “Tennis Centers”); and

 

WHEREAS, the Atlanta City Council adopted Resolution 09-R-1512 on September 8, 2009, and the Mayor approved the same on September 11, 2009 which authorized the City to enter into Agreement FC-4944, Special Procurement for Management and Operation of Various Tennis Centers (“Agreement”) with Universal Tennis Management LLC (“UTM”) to provide programming services and operation and maintenance of the Tennis Centers for an initial term of five (5) years with two (2), two-year renewal options; and

 

WHEREAS, the City entered into Amendment No. 1 of the Agreement with UTM, pursuant to Resolution 11-R-1659 that was adopted by Atlanta City Council on November 21, 2011 and approved per City Charter Section 2-403 on November 30, 2011; and

 

WHEREAS, the City and UTM entered into Amendment No. 2 and Renewal Option No. 1 of the Agreement pursuant to Resolution 14-R-3988 that was adopted by Atlanta City Council on August 18, 2014 and approved per City Charter Section 2-403 on August 27, 2014; and

 

WHEREAS, the City and UTM entered into Renewal Option No. 2 of the Agreement pursuant to Resolution 16-R-4355 that was adopted by Atlanta City Council on September 19, 2016 and approved per City Charter Section 2-403 on September 28, 2016; and

 

WHEREAS, the Chief Procurement Officer authorized  a 90-day extension for the Agreement, resulting in a new expiration date of August 10, 2019; and 

 

WHEREAS, the Commissioner of the Department of Parks and Recreation and the Chief Procurement Officer recommend entering into Amendment No. 3 to extend the Agreement on a month-to-month basis for a period not to exceed six (6) months effective on August 11, 2019; and

WHEREAS, Amendment No. 3 is set to expire on February 11, 2020 and the Commissioner of Parks and Recreation and Chief Procurement Officer recommend entering into Amendment No. 4 to extend the Agreement on a month-to-month basis for a period not to exceed six (6) months effective on February 11, 2020.

 

 

THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY ORDAINS: 

 

Section 1: The Mayor or her designee is hereby authorized to enter into Amendment No. 4 for FC-4944, Special Procurement for Management and Operation of Various Tennis Centers to extend the term of the Agreement on a month-to-month basis for a period not to exceed six (6) months effective on February 11, 2020 with the option for the City, in its sole discretion, to terminate the Agreement at any time during the six (6) month period, conditioned upon the Department of Parks and Recreation giving Universal Tennis Management, LLC  thirty (30) days written notice of such early termination. 

 

Section 2: The services provided by Universal Tennis Management, LLC from February 11, 2020 through the execution of Amendment No. 4 are hereby ratified.

 

Section 3: Section 2-1187 of Article X of the Procurement and Real Estate Code of the City of Atlanta Code of Ordinances is hereby waived to the extent of any conflict with this Ordinance.

 

Section 4: The Chief Procurement Officer, in consultation with the City Attorney, is directed to prepare all appropriate documents for execution by the Mayor, or her authorized designee.

 

Section 5: Amendment No. 4 of FC-4944, Special Procurement for Management and Operation of Various Tennis Centers will not become binding upon the City, and the City will incur no obligation or liability under it until it has been approved by the City Attorney as to form, executed by the Mayor, attested to by the Municipal Clerk and delivered to Universal Tennis Management LLC.
