Z-17-16 AN ORDINANCE BY COUNCILMEMBER JOYCE M. SHEPERD AS SUBSTITUTED BY ZONING COMMITTEE TO AMEND THE O-I (OFFICE INSTITUTIONAL), C-3 (COMMERCIAL RESIDENTIAL), I-1 (LIGHT INDUSTRIAL), I-2 (HEAVY INDUSTRIAL) AND MRC (MIXED RESIDENTIAL COMMERCIAL) ZONING DISTRICT REGULATIONS SO AS TO PROHIBIT STORAGE FACILITIES ON PROPERTY WITHIN SAID DISTRICTS WHEN ANY PART OF SUCH PROPERTY IS ALSO WITHIN 500 FEET OF THE BELTLINE CORRIDOR; AND FOR OTHER PURPOSES.

Body

 

WHEREAS, for property within the Beltline Overlay Zoning District, the permitted principal and accessory uses of such property are governed by the underlying zoning requirements unless specifically prohibited by the Beltline Overlay Zoning District regulations; and

 

WHEREAS, within the Beltline Overlay Zoning District, the underlying zoning districts of 0-I, C-3, I-1, I-2 and MRC permit storage facilities as principal uses, in one form or another, as more specifically set forth in the zoning regulations governing said districts; and

 

WHEREAS, the City Council finds that storage facilities (whether delineated as secured storage facility, mixed-use storage facility, secured-storage  facility, or self-storage facility) on any property within 500 feet of the Beltline Corridor are incompatible with the objectives, purposes and intent of said district; and

 

WHEREAS, the Beltline Corridor, as defined in City Code Sec. 16-36.007, means property located inside the Beltline Overlay District that is:

 

a. Owned by or subject to easements owned by, leased, or otherwise in favor of the

Georgia Department of Transportation or a railroad subject to the jurisdiction of the Interstate Commerce Commission Termination Act of 1995, 49 U.S.C. §

10101, et seq. and used for transit related purposes; or b. Shown as railroad right-of-way on the City of Atlanta 200 foot scale cadastral maps as maintained by the bureau of planning as of November 20, 2006; or c. Shown as part of the transit corridor by the BeltLine Redevelopment Plan adopted by the City of Atlanta in November 2005 (and as amended by map Attachment B).

 

WHEREAS, the intent of this ordinance is to prohibit new storage facilities (whether delineated as secured storage facility, mixed-use storage facility, secured-storage facility, or self-storage facility) as principal uses on any property within 500 feet of the Beltline Corridor even when the property's underlying zoning district would otherwise permit such use; and

 

WHEREAS, it is the intent of this ordinance to permit existing storage facilities (whether delineated as secured storage facility, mixed-use storage facility, secured-storage facility, or self- storage facility) as of the date of this ordinance to rebuild or rehabilitate subject to all requirements of the Atlanta Zoning Ordinance, including but not limited to the Beltline Overlay District requirements, in order to encourage aesthetic and site improvement to such existing facilities; and

 

WHEREAS, the City Council finds that amendment of the regulations governing principal uses

in the 0-I, C-3, I-1, I-2 and MRC is necessary to accomplish this intent; and

 

WHEREAS,  the City Council finds that this amendment is in furtherance of the public health, safety and general welfare.

 

NOW THEREFORE THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY ORDAINS AS FOLLOWS:

 

Section 1: City Code Sec. 16-10.003, governing permitted uses in the 0-I zoning district is amended so that sub-paragraph (20) which reads:

 

(20) Secured storage facility, is hereby amended to read:

(20) Secured storage facility except when any part of the property is within 500 feet of the beltline corridor as defined in City Code Section 16-36.007. An existing secured storage facility within 500 feet of the beltline corridor may be redeveloped at its existing floor area ratio and consistent with the requirements of this part

 

Section 2: City Code Sec. 16-10.003, governing permitted uses in the 0-I zoning district is amended so that sub-paragraph (21) which reads:

 

(21) Mixed-use storage facility, is hereby amended to read:

(21) Mixed-use storage facility except when any part of the property is within 500 feet of the beltline corridor as defined in City Code Section 16-36.007. An existing mixed­ use secured storage facility within 500 feet of the beltline corridor may be redeveloped at its existing floor area ratio and consistent with the requirements of this part.

 

 

Section 3: City Code Sec. 16-13.003, governing permitted uses in the C-3 zoning district is amended so that sub-paragraph (21) which reads:

 

(21) Secured-Storage facility,

 

Is hereby amended to read:

 

(21) Secured-storage facility except when any part of the property is within 500 feet of

the beltline corridor as defined in City Code Section 16-36.007. An existing secured

storage facility within 500 feet of the beltline corridor may be redeveloped at its

existing floor area ratio and consistent with the requirements of this part.

 

Section 4: City Code Sec. 16-16.003, governing permitted uses in the I-1 zoning district is

amended so that sub-paragraph (20) which reads:

 

(20) Warehousing, self-storage facilities, distribution centers,

 

is hereby amended to read:

 

(20) Warehousing, self-storage facilities except when any part of the property is within

500 feet of the beltline corridor as defined in City Code Section 16-36.007, distribution

centers. An existing self-storage facility within 500 feet of the beltline corridor may be

redeveloped at its existing floor area ratio and consistent with the requirements of this.

 

Section 5: City Code Sec. 16-17.003, governing permitted uses in the I-2 zoning district is

amended so that sub-paragraph (21) which reads:

 

(21) Warehousing, self-storage facilities, distribution centers,

 

is hereby amended to read:

 

(21) Warehousing, self-storage facilities except when any part of the property is within

500 feet of the beltline corridor as defined in City Code Section 16-36.007, distribution centers. An existing self-storage facility within 500 feet of the beltline corridor may be redeveloped at its existing floor area ratio and consistent with the requirements of this part.

 

Section 6: City Code Sec. 16-34.005, governing permitted uses in the MRC zoning district is amended so that sub-paragraph (26) which reads:

 

26. Subject to the requirements of section 16-34.010(7), mixed-use storage facility having less than 100,000 square feet of total floor area of storage use,

 

is hereby amended to read:

 

26. Subject to the requirements of section 16-34.010(7) and not when any part of the

property is within 500 feet of the beltline corridor as defined in City Code Section 16-

36.007, mixed-use storage facility having less than 100,000 square feet of total floor

area of storage use. An existing mixed-use storage facility within 500 feet of the

beltline corridor may be redeveloped at its existing floor area ratio and consistent with

the requirements of this part.

 

Section 7: Those parcels, or portions of parcels within 500 feet of the beltline corridor are

depicted in the map titled "Parcels within 500ft of the Beltline Corridor", which map is

incorporated herein by reference. This map is a public record and is available for public

inspection in the Office of Zoning and Development.
